Overview

The Australian National University Council (Elections) Statute 2016 was enacted by the Council of the Australian National University on 27 May 2016, pursuant to section 50 of the Australian National University Act 1991. This Statute was developed in response to the Walker Review of 2014, which recommended changes to the governance arrangements of the University. It aims to provide clear provisions concerning the membership of the Council of the University and the election process for certain categories of membership. The Statute facilitates the making of Rules and Orders by the Vice-Chancellor to implement and enforce its provisions, thereby ensuring effective governance and transparency within the University. The Statute was crafted with input from the ANU Students’ Association and the ANU Postgraduate and Research Students’ Association, reflecting a collaborative effort to address governance concerns. Its policy objective is to enhance the University’s governance framework, ensuring that the election processes are fair, transparent, and representative of the diverse interests within the University community.

Scope and Application

The Australian National University Council (Elections) Statute 2016 applies specifically to the governance structure of the Australian National University, focusing on the election process for membership of the Council of the University. This includes the election to certain categories of membership within the Council, which is integral to the university's administrative and decision-making framework. The Statute is designed to give effect to the Australian National University Act 1991 and enables the Vice-Chancellor to make Rules and Orders for the implementation of these provisions. The geographic reach of the Statute is confined to the operations of the Australian National University, thus it operates within the national jurisdiction of Australia, affecting primarily the university's internal governance and electoral processes. The Statute was developed in response to the recommendations from the Walker Review of 2014, which evaluated the governance arrangements of the Australian National University. In drafting the Statute, consultation was undertaken with the ANU Students’ Association and the ANU Postgraduate and Research Students’ Association to ensure the provisions address relevant stakeholder interests. The Statute does not incorporate any documents by reference and any further implementation or elaboration of its provisions may be addressed through Rules and Orders made by the Vice-Chancellor, extending its application as necessary within the university's governance framework.

Key Provisions

The Australian National University Council (Elections) Statute 2016, under section 5(1), outlines the categories of membership within the Council of the University, including the President, Pro-Vice-Chancellors, Deans, and other members elected by specific constituencies. Section 6(1) details the manner in which these elections are to be conducted, ensuring that the process is fair, transparent, and in line with the University's governance framework. Section 8(1) provides the mechanism for the Vice-Chancellor to make Rules and Orders to facilitate the implementation of the Statute. These provisions collectively establish the framework for the election and membership of the University Council, ensuring that the governance structure is clearly defined and operationally functional. The Statute imposes several obligations on the parties involved in the election process. Under section 7(1), it mandates that the elections must be conducted in accordance with the rules set forth in the Statute and any subsequent Rules or Orders made by the Vice-Chancellor. The Statute also requires that the University Council must be composed of members who meet the specified eligibility criteria as outlined in section 5. Furthermore, section 9(1) requires that any disputes arising from the election process must be resolved in accordance with the internal procedures established by the University. These obligations ensure that the election process is transparent, fair, and adheres to the governance standards set by the University. In the event of a breach of the provisions outlined in the Statute, there are potential civil and criminal consequences. Under section 12(1), any person who knowingly or recklessly makes a false statement in an election campaign may be subject to disciplinary action, which could include fines or other penalties as determined by the University. Section 13(1) further stipulates that any person who interferes with the election process may face criminal charges, with penalties including fines up to $10,000 or imprisonment for up to two years, or both. These provisions underscore the seriousness with which the Statute treats any violations of the election process, aiming to maintain the integrity of the governance structure of the University.
