Overview

The Corporations (Relevant Providers—Approval of Personal Qualifications) (Approved Forms) Instrument 2023 was enacted to provide streamlined and standardised application forms for individuals seeking approval of their qualifications under the Corporations Act 2001. This instrument was made under the authority of the Corporations Act 2001 and is designed to address the need for clear and uniform application processes for both domestic and foreign qualifications. The forms approved by this instrument are intended to facilitate the application process for relevant providers by ensuring that all necessary information is provided in a consistent and easily accessible format. The policy objective behind this instrument is to enhance the efficiency and transparency of the qualification approval process, thereby supporting the proper functioning of the corporate sector in Australia. This instrument was enacted by the Parliament of Australia and includes amendments made by the Corporations (Relevant Providers—Approval of Personal Qualifications) (Approved Forms) Amendment Instrument 2025. The amendments apply to applications made on or after 26 November 2025, reflecting updates to ensure the forms remain relevant and effective. The approved forms are intended to simplify the application process, making it easier for applicants to provide the required information and for the relevant authorities to assess their qualifications.

Scope and Application

The Corporations (Relevant Providers—Approval of Personal Qualifications) (Approved Forms) Instrument 2023 applies to the approval of application forms for both foreign and domestic qualifications as specified under the Corporations Act 2001. This instrument is made under the authority of the Act and is designed to streamline the process for individuals seeking approval of their qualifications to work within relevant sectors, specifically targeting entities and professionals regulated under the Corporations Act. The approved forms, detailed in Schedules 1 and 2, are intended to ensure consistency and compliance in the submission of qualification approval applications to the Minister. The geographic reach of this instrument is national, as it applies uniformly across Australia. Any amendments, such as those introduced by the Corporations (Relevant Providers—Approval of Personal Qualifications) (Approved Forms) Amendment Instrument 2025, apply to applications made on or after 26 November 2025, thereby extending the scope of the approved forms to include any new requirements or changes in the approval process.

Key Provisions

The Corporations (Relevant Providers—Approval of Personal Qualifications) (Approved Forms) Instrument 2023 (the Instrument) sets forth the approved forms for applications related to the approval of personal qualifications under the Corporations Act 2001. Specifically, section 5 of Part 2 of the Instrument approves the form in Schedule 1 for applications seeking approval of foreign qualifications, while section 6 of Part 2 approves the form in Schedule 2 for applications seeking approval of domestic qualifications. These forms must be used for submissions to the Minister for approval purposes as outlined in sections 921G and 921GA of the Act. The obligations imposed by the Instrument on the relevant parties, particularly applicants and the Minister, include the requirement to use the approved forms for their respective applications. Applicants must ensure that their applications for the approval of foreign or domestic qualifications are submitted using the forms approved under sections 5 and 6. The Minister, in turn, is required to process these applications in accordance with the provisions of the Act. The approved forms ensure that all necessary information and documentation are provided in a standardised format, facilitating the review and approval process. Breaching the requirements of the Instrument by not using the approved forms for applications can lead to various consequences. Under the Corporations Act 2001, failure to comply with the prescribed application procedures may result in the application being deemed invalid. This could potentially delay or prevent the approval process, impacting the applicant's ability to meet professional or regulatory standards. Additionally, repeated non-compliance might attract further scrutiny or penalties under other sections of the Act, although specific penalties for such breaches are not detailed within the Instrument itself. The approved forms are critical in maintaining consistency and compliance in the application process.
