The amendments made by Schedule 1 to the Corporations (Relevant Providers—Approval of Personal Qualifications) (Approved Forms) Amendment Instrument 2025 apply to applications made on or after 26 November 2025.

Key Provisions
The Corporations (Relevant Providers—Approval of Personal Qualifications) (Approved Forms) Amendment Instrument 2025 (hereinafter referred to as the "Instrument") amends the Corporations (Relevant Providers—Approval of Personal Qualifications) (Approved Forms) Instrument 2023. The Instrument comes into effect on 26 November 2025. It is made under the authority of the Corporations Act 2001, with Dr. Andre Moore, Assistant Secretary, Advice, Insurance and Capital Markets Branch, Financial System Division, Department of the Treasury, acting as the delegate of the Minister. The Instrument amends the approved forms for applications for the approval of foreign and domestic qualifications of relevant providers.
The amendments introduced by the Instrument require the use of new forms for applications made on or after 26 November 2025. Specifically, it repeals the existing schedules and substitutes them with new forms. The new forms are approved under subsection 921G(1) of the Corporations Act 2001 for foreign qualifications and under paragraph 921GA(2)(b) for domestic qualifications. These new forms must be used for all applications submitted from the commencement date.
The obligations imposed by the Instrument include ensuring that all applications for the approval of personal qualifications of relevant providers are made using the new forms specified in the Instrument. This requirement applies to both foreign and domestic qualifications. Any application submitted prior to the commencement date of 26 November 2025 using the old forms will not be accepted.
Failure to comply with the requirements of the Instrument may result in significant consequences. The Corporations Act 2001 provides for both civil and criminal penalties for non-compliance. Civil penalties can include fines up to a maximum of $210,000 for individuals and $1,050,000 for bodies corporate, depending on the severity of the breach. Additionally, criminal penalties may be imposed for more serious or repeated breaches, with maximum fines of up to $210,000 for individuals and $1,050,000 for bodies corporate, along with potential imprisonment terms. These penalties underscore the importance of adhering to the new forms and the specified commencement date.
