Overview

The Control of Defence Areas Regulations 1932, issued under the Defence Act 1903-1927, were enacted to address the growing need for the regulation of defence areas, particularly with the rise of civil aviation during the early 20th century. These Regulations were established by the Governor-General in Council, acting on advice from the Federal Executive Council. They were designed to provide a framework for the control and management of specified areas designated as defence zones, ensuring that these areas could be effectively managed to support national security and civil aviation needs. This legislative instrument aimed to update and extend the scope of areas under defence control to include newly identified civil aviation aerodromes across various states in Australia, thereby addressing the gap in managing these critical infrastructures under defence regulations.

Scope and Application

The Control of Defence Areas Regulations, made under the Defence Act 1903-1927, apply to civil aviation aerodrome areas within specific states and territories of Australia. These regulations delineate and control areas designated for defence purposes, particularly focusing on civil aviation aerodromes. The amendments to the Schedule to these regulations introduce new areas in each state and territory, detailing the boundaries of these aerodrome areas through descriptions and referenced plans. The regulations apply to any person or entity operating within these designated aerodrome areas, ensuring compliance with the Defence Act and related regulations. Geographically, the application of these regulations is nationwide, encompassing all states and territories of Australia, as evidenced by the inclusion of areas in Queensland, New South Wales, Victoria, South Australia, Western Australia, and Tasmania. There are no stated exclusions or exemptions within the text provided, and the scope of the regulations is extended through the incorporation of specific plans and descriptions referenced in the Commonwealth of Australia Gazette.

Key Provisions

The Control of Defence Areas Regulations, as amended, establish specific areas designated as civil aviation aerodromes in various states of Australia, as listed in Tables A, B, and C of the Schedule. These areas include Archerfield in Queensland, Mascot in New South Wales, Essendon in Victoria, Parafield in South Australia, Maylands in Western Australia, and Western Junction in Tasmania. The descriptions provided in these tables are based on the plans attached to the relevant gazette notifications, which visually depict the exact locations and boundaries of these aerodromes. The Regulations impose obligations on various parties, including the Defence Force, local authorities, and the general public, to comply with the designated boundaries and any restrictions that may apply within these areas. For instance, unauthorised entry, construction, or other activities that could interfere with the operation of the aerodromes are likely prohibited. The Regulations may also specify procedures for obtaining permission to enter or operate within these areas, ensuring the safety and efficiency of civil aviation activities. Breaches of the Control of Defence Areas Regulations can result in both civil and criminal penalties, depending on the nature and severity of the offence. Civil penalties may include fines, while criminal offences can lead to more severe consequences. The exact penalties are not detailed in the excerpt provided but would typically be found in the Defence Act 1903-1927 or other related legislation. The potential penalties could range from fines to imprisonment, depending on the specific breach and the discretion of the court.
