Overview

Statutory Rules 1911 No. 179, titled "Provisional Regulations Under the Defence Act 1903-1910," was enacted to address the urgent need for regulating the conduct and management of government factories and the employment of persons as stipulated under Section 63, Sub-sections 1 and 2 of the Defence Acts. These Provisional Regulations were issued by the Governor-General in Council, acknowledging the urgency of the situation and thus mandating immediate operation. The overarching objective of these regulations is to provide a clear framework for the administration of government factories and the employment conditions of personnel, ensuring consistency and fairness in the allowances and benefits provided to officers and employés, particularly in the context of inter-state travel.

Scope and Application

The Provisional Regulations under the Defence Act 1903-1910, as outlined in statutory rules 1911 No. 179, pertain to the conduct and management of government factories and the employment of persons. These regulations apply to individuals employed in government factories who are subject to Section 63, Sub-sections 1 and 2 of the Defence Acts. The regulations also cover the travel allowances for these employees, with specific provisions for those who travel beyond the limits of the state in which they are ordinarily employed. This particular legislative instrument has immediate effect due to its urgency, as certified by the Governor-General. The regulations are applicable throughout the Commonwealth of Australia, with specific provisions excluding employees at border stations when temporarily transferred to the opposite side of the border. The regulations amend the previous allowances, establishing a new scale of travelling allowances, and also include provisions for daily allowances after one week's residence in the same place and hourly rates for employees absent for more than one-fourth of a day.

Key Provisions

The main operative sections of these Provisional Regulations concern the management of government factories and the allowances for officers and employés travelling for work purposes. Specifically, Regulation 76 establishes a scale of travelling allowances based on salary, with different rates for daily and hourly allowances, and provisions for allowances after one week's residence in the same place. Additionally, Regulation 78 stipulates that officers or employés who travel beyond the limits of the state in which they are ordinarily employed will receive an increased allowance of one-fifth on the scale rates, with exceptions for those temporarily transferred to stations on or near the opposite border. These Regulations impose several obligations on the parties involved. Firstly, government factories must adhere to the prescribed scale of travelling allowances for officers and employés, ensuring that appropriate compensation is provided for work-related travel. Furthermore, officers and employés are required to submit accurate records of their travel to claim the relevant allowances, and they must ensure compliance with the provisions regarding travel beyond state borders. Failure to comply with these Provisional Regulations may result in various consequences, although specific offences and penalties are not detailed in the text provided. Typically, breaches of regulations governing allowances and employment conditions can lead to disciplinary action, financial penalties, or other administrative measures. However, the exact nature and severity of these consequences would depend on the specific circumstances of non-compliance and the applicable laws and regulations at the time.
