Overview
The Completion of Kakadu National Park (Koongarra Project Area Repeal) Act 2013 was enacted by the Parliament of Australia to address the need for the repeal of outdated legislation that was no longer serving its intended purpose. This Act repeals the Koongarra Project Area Act 1981, which had been established to regulate activities in the Koongarra Project Area within the Kakadu National Park. The 2013 Act was introduced to streamline and modernise the legal framework surrounding the park, ensuring it aligns with contemporary environmental and administrative standards. The policy objective of this Act is to remove obsolete and redundant legislative provisions, thereby facilitating better management and conservation of the national park. The Act came into effect on the day following its Royal Assent on 30 March 2013.
Scope and Application
The Completion of Kakadu National Park (Koongarra Project Area Repeal) Act 2013 is a Commonwealth Act that repeals the Koongarra Project Area Act 1981, aiming to finalise the Koongarra Project Area within the Kakadu National Park. The Act applies to the geographical area known as the Koongarra Project Area, within the boundaries of Kakadu National Park, and nullifies any legal framework previously established by the repealed Act. It is intended to streamline legislative oversight and management within this specific area. The repeal takes effect from the day after the Act receives Royal Assent, signifying the immediate commencement of its effect. This Act operates within the national jurisdiction of Australia, specifically targeting the legal status and administrative framework of the Koongarra Project Area. There are no stated exclusions, exemptions, or thresholds in the Act itself, but the scope of its application is inherently limited to the geographical and administrative specifics of the Koongarra Project Area within Kakadu National Park. The Act does not extend its application through subordinate instruments; its primary function is the repeal of the specified earlier legislation.
Key Provisions
The main operative sections of the Completion of Kakadu National Park (Koongarra Project Area Repeal) Act 2013 are outlined in the short title, commencement, and Schedule 1. Section 1 provides the short title of the Act, identifying it as the "Completion of Kakadu National Park (Koongarra Project Area Repeal) Act 2013." Section 2 states that the Act commences on the day after it receives the Royal Assent. Schedule 1 contains the repeal of the Koongarra Project Area Act 1981, indicating that the entirety of that Act is to be repealed.
The Act imposes the obligation to repeal the Koongarra Project Area Act 1981. This repeal is comprehensive, as indicated in Schedule 1, which specifies that the whole of the Koongarra Project Area Act 1981 is repealed. This means that all provisions, regulations, and powers associated with the Koongarra Project Area Act 1981 are no longer in effect from the day after the Act receives Royal Assent. The repeal effectively removes the legal framework that was previously in place for the Koongarra Project Area within Kakadu National Park.
There are no specific offences, penalties, or consequences for breach detailed in the Act itself. The primary focus of the Act is the repeal of the Koongarra Project Area Act 1981, and it does not explicitly outline any civil or criminal consequences for non-compliance with its provisions. However, it is important to note that the repeal of an Act means that any activities or actions previously governed by the repealed Act would need to comply with new or existing laws applicable to Kakadu National Park. Failure to comply with these new or existing laws could result in penalties or legal consequences under those laws.
