Part 1—Preliminary

 

1  Name

  This instrument is the Competition and Consumer (Industry Codes—Franchising) (Treasury) Delegations 2022.

3  Authority

  This instrument is made under the Competition and Consumer (Industry Codes—Franchising) Regulations 2024.

4  Definitions

Note: Expressions have the same meaning in this instrument as in the Competition and Consumer (Industry Codes—Franchising) Regulations 2024 as in force from time to time—see paragraph 13(1)(b) of the Legislation Act 2003.

 (1) In this instrument:

the Regulations means the means the Competition and Consumer (Industry Codes—Franchising) Regulations 2024.

the Treasury means the Department of the Treasury.

Part 2—Delegations

 

5  Delegations relating to Franchise Disclosure Register

 (1) Under subsection 96(1) of the Regulations, each person holding, occupying or performing the duties of each of the following offices or positions in the Treasury, is delegated the Secretary’s functions and powers under Part 7 of Chapter 2 of the Regulations:

 (a) a Deputy Secretary;

 (b) an SES employee.

Note: Part 7 of Chapter 2 of the Regulations to the establishment and maintenance of the Franchise Disclosure Register.

A misdescribed amendment is an amendment that does not accurately describe how an amendment is to be made. If, despite the misdescription, the amendment can be given effect as intended, then the misdescribed amendment can be incorporated through an editorial change made under section 15V of the Legislation Act 2003.

If a misdescribed amendment cannot be given effect as intended, the amendment is not incorporated and “(md not incorp)” is added to the amendment history.
