Overview

The Competition and Consumer (Consumer Data Right—Recognised External Dispute Resolution Schemes) Instrument 2021 was enacted to address the need for recognised external dispute resolution schemes for the resolution of disputes in the banking and energy sectors relating to the operation of the consumer data rules or Part IVD of the Competition and Consumer Act 2010. This instrument was made by Jane Hume, Minister for Superannuation, Financial Services and the Digital Economy, and Minister for Women’s Economic Security, under the authority of the Competition and Consumer Act 2010. The policy objective of this instrument is to ensure that consumers have access to effective external dispute resolution mechanisms in the banking and energy sectors, facilitating the resolution of disputes concerning consumer data rights. The instrument recognises specific external dispute resolution schemes for these sectors, thereby enhancing consumer protection and promoting fair competition.

Scope and Application

The Competition and Consumer (Consumer Data Right—Recognised External Dispute Resolution Schemes) Instrument 2021 applies to the resolution of disputes in the banking and energy sectors concerning the operation of the consumer data rules or Part IVD of the Competition and Consumer Act 2010. It applies to the entities listed in subsection 56DA(1) of the Act and involves the schemes operated by the Australian Financial Complaints Authority Limited in the banking sector, and additional bodies in the energy sector, including the Energy and Water Ombudsman for various states. The instrument’s jurisdiction extends nationally, but its specific application is confined to the designated sectors and their respective dispute resolution entities. The instrument also repeals the previous Competition and Consumer (External Dispute Resolution Scheme–Banking Sector) Instrument 2019, ensuring that current regulations are aligned with the new framework. This instrument is made under the authority of the Competition and Consumer Act 2010 and comes into effect on the day after it is registered.

Key Provisions

The main operative sections of the Competition and Consumer (Consumer Data Right—Recognised External Dispute Resolution Schemes) Instrument 2021 (the "Instrument") include sections 6 and 7, which recognise specific external dispute resolution (EDR) schemes for the banking and energy sectors, respectively (ss 6, 7). Section 6 recognises the Australian Financial Complaints Authority Limited for the banking sector, while section 7 recognises multiple bodies for the energy sector, including the Australian Financial Complaints Authority Limited and various state-based Energy and Water Ombudsman entities (s 6(2), s 7(2)). The Instrument imposes obligations on the recognised EDR schemes to resolve disputes in the banking and energy sectors relating to the operation of consumer data rules and Part IVD of the Competition and Consumer Act 2010 (the "Act") (s 6, s 7). The recognised schemes must be able to handle disputes involving one or more of the persons covered by paragraph 56DA(1)(b) of the Act (s 6(1), s 7(1)). Failure to comply with the requirements of the Instrument may result in civil or criminal consequences under the Act. However, the Instrument itself does not specify any particular offences, penalties, or civil/criminal consequences for non-compliance. The penalties for breaches of the Act may vary depending on the specific provisions of the Act that are contravened and could include fines and imprisonment (Act, ss 131, 132).
