Competition and Consumer (Consumer Data Right—Participating Victorian Government entity) Declaration 2022

I, Jane Hume, Minister for Superannuation, Financial Services and the Digital Economy and Minister for Women's Economic Security, being satisfied that the Victorian Government has agreed to the entity specified in this declaration participating under Part IVD of the Competition and Consumer Act 2010, as required by subsection 56AS(2) of that Act, make the following declaration.

Part 1—Preliminary

 

1  Name

  This instrument is the Competition and Consumer (Consumer Data Right—Participating Victorian Government entity) Declaration 2022.

2  Commencement

 (1) Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

  This instrument is made under the Competition and Consumer Act 2010.

4  Definitions

Note: Paragraph 13(1)(b) of the Legislation Act 2003 has the effect that expressions have the same meaning in this instrument as in the Competition and Consumer Act 2010 as in force from time to time.

  In this instrument:

the Act means the Competition and Consumer Act 2010.

the CDR Rules means the Competition and Consumer (Consumer Data Right) Rules 2020.

Part 2—Participating Department of State

 

5  Participating Victorian Government entity

  Under subsection 56AS(1) of the Act, all or a part of the Department of State administered by the Minister of Victoria administering the National Electricity (Victoria) Act 2005 (Vic.), is declared to be a participating entity for the State of Victoria.

Note: Under subsection 56AR(2) of the Act, the provisions of Part IVD of the Act, regulations made for the purposes of that Part and the consumer data rules, apply in accordance with subsection 56AR(4) of the Act, to State or Territory government entities that are declared to be participating entities for the State or Territory under subsection 56AS(1) of the Act.

6  Meaning of tranche 1 (VA) date

  For the purposes of the definition of tranche 1 (VA) date in clause 8.1 of Schedule 4 to the CDR Rules, the specified date is 15 November 2022.
