Overview

The Competition and Consumer Act 2010 was enacted to address issues of market competition and consumer protection in Australia. One of the mechanisms it provides is the ability for the Minister to declare certain goods or services as notified, and entities providing these goods or services as declared persons, thereby restricting their ability to increase prices as specified in the Act. The Parliament of Australia introduced Declaration No. 94 under Section 95X of this Act to continue and extend the price notification arrangements for aeronautical services and facilities for regional air services to and from Sydney Kingsford Smith Airport. The declaration pertains to Sydney Airport Corporation Ltd and is effective from 1 July 2016 until 30 June 2019. This legislative instrument ensures that the corporation’s price-setting powers are regulated to protect consumers and maintain competitive market conditions. The declaration was made without public consultation as it extends the arrangements of a previous lapsed declaration, and it has been assessed to be compatible with human rights as it does not engage any applicable rights or freedoms.

Scope and Application

The Competition and Consumer Act 2010 applies broadly to various entities and conduct within Australia, with its jurisdiction extending across the Commonwealth, states, and territories. This Act is concerned with regulating anti-competitive behaviour, ensuring fair trading practices, and protecting consumer rights. Specific to this context, the Act includes provisions that allow the Minister to declare certain entities as "declared persons" in relation to specified goods or services, thereby restricting their ability to increase prices for those goods or services. Declaration No. 94, under section 95X of the Act, designates Sydney Airport Corporation Ltd as a declared person concerning aeronautical services and facilities for regional air services to and from Sydney Kingsford Smith Airport. This declaration imposes restrictions on the airport corporation's ability to increase the price of these services, as outlined in section 95Z of the Act. The declaration is effective from 1 July 2016 and will cease on 30 June 2019, unless otherwise extended or amended through subordinate instruments. The Act's provisions are designed to ensure fair pricing and maintain competitive balance in designated sectors, thereby protecting both consumers and smaller businesses reliant on these services.

Key Provisions

The primary operative sections of this legislation are sections 95X and 95Z of the Competition and Consumer Act 2010. Section 95X (1) allows the Minister to declare a person, in this case Sydney Airport Corporation Ltd, as a "declared person" in relation to specific goods or services, which in this instance are aeronautical services and facilities for regional air services to and from Sydney Kingsford Smith Airport. Section 95Z (1) stipulates the conditions under which the declared person can increase the prices of these notified goods or services. These provisions aim to ensure that the price increases are reasonable and do not exceed what is necessary to maintain or improve the quality of the services provided. The obligations and requirements imposed on Sydney Airport Corporation Ltd by this legislation are primarily concerned with the restrictions on price increases for the specified aeronautical services and facilities. Under section 95Z (2), the declared person must notify the Minister of any proposed price increases and provide justification for these increases. Additionally, section 95Z (3) requires the declared person to ensure that the price increases do not exceed a predetermined limit, which is intended to protect consumers from excessive price hikes. The declared person must also maintain records and documentation that substantiate the need for any price increases, which can be reviewed by the Minister or relevant authorities. Failure to comply with the provisions outlined in this legislation may result in legal consequences. While the explanatory statement does not explicitly outline specific offences or penalties, the Competition and Consumer Act 2010 provides a framework for enforcement. In general, breaches of the Act can lead to civil penalties, including fines up to $1.1 million for corporations. Additionally, individuals found guilty of serious breaches may face criminal penalties, including fines and imprisonment. The enforcement of these provisions ensures that Sydney Airport Corporation Ltd adheres to the set guidelines for price increases, thereby protecting consumers from unfair pricing practices.
