The purpose of the proposed Statutory Rules is to increase, from 1 November 1985. the rates and amounts of compensation benefits payable under the Compensation (Commonwealth Government Employees) Act 1971.

Regulation 1 of the proposed Statutory Rules defines “Principal Regulations” to mean the Compensation (Commonwealth Government Employees) Regulations.

Regulation 2 of the proposed Statutory Rules amends Regulation 27 of the Compensation (Commonwealth Government Employees) Regulations to prescribe a rate of $20.50 a week for the purposes of sub-section 43(5) of the Principal Act.

Accordingly, the rate of weekly payment in respect of each dependent child of a deceased employee is increased from $20.00 a week to $20.50 a week.

Regulation 4 of the proposed Statutory Rules amends Schedule 4 of the Compensation (Commonwealth Government Employees) Regulations to prescribe new amounts of benefits under Regulation 26 which will apply the prescribed amounts for the purposes of various provisions of the Principal Act. Schedule 4 operates to increase compensation benefits as follows:

An increase in this amount has the effect of increasing the amount of compensation payable for other specified losses resulting from an injury in the same proportion. The compensation entitlement for these losses is expressed as a percentage of the maximum figure (eg loss of a leg below the knee attracts a payment of 651 of the amount payable for total loss of sight).

Overview

The Compensation (Commonwealth Government Employees) Regulations (Amendment) Statutory Rules 1985 No. 284 were enacted to increase the rates and amounts of compensation benefits payable under the Compensation (Commonwealth Government Employees) Act 1971, addressing the need to adjust benefits in response to inflation and other economic factors. Issued by the authority for the Minister of State for Social Security, these regulations were designed to ensure that compensation remains adequate and reflective of current economic conditions. The policy objective of these amendments is to provide fair and timely compensation to Commonwealth government employees and their dependants in the event of injury or death arising from their employment, thereby maintaining the integrity and effectiveness of the compensation framework established under the Principal Act. These Statutory Rules amend various regulations to increase weekly payments, lump sum payments, and other benefits payable under the Principal Act, effective from 1 November 1985. By increasing compensation rates for dependents, attendant’s allowances, and various injury-related benefits, the regulations aim to support affected employees and their families more effectively. This amendment ensures that the compensation system remains responsive to the evolving economic landscape and the needs of those who rely on it, thereby reinforcing the social security framework for Commonwealth government employees.

Scope and Application

The Compensation (Commonwealth Government Employees) Act 1971 applies to Commonwealth government employees who are injured or incapacitated in the course of their employment. It provides for compensation benefits to these employees and their dependants. The Act is a Commonwealth law and thus has national jurisdictional reach, applying uniformly across Australia. The proposed Statutory Rules, which are amendments to the Compensation (Commonwealth Government Employees) Regulations, serve to increase various rates and amounts of compensation benefits payable under the Act. The increased rates and amounts include weekly payments for dependent children of deceased employees, attendant’s allowances, compensation for various injuries and losses, and other specified benefits. The amendments are set to take effect from 1 November 1985, with specific provisions for when the increased weekly and lump sum compensation amounts apply. These regulations do not introduce any exclusions, exemptions, or thresholds but rather adjust existing provisions to reflect the increased rates of compensation.

Key Provisions

The Compensation (Commonwealth Government Employees) Regulations (Amendment) Statutory Rules 1985 No. 284 primarily revise the rates and amounts of compensation benefits payable under the Compensation (Commonwealth Government Employees) Act 1971. Regulation 2 increases the weekly payment for each dependent child of a deceased employee from $20.00 to $20.50, as per sub-section 43(5) of the Principal Act. Regulation 3 raises the attendant's allowance rate from $28.00 to $28.70 for employees requiring constant assistance, under sub-section 48(1). Regulation 4 updates various compensation benefits, such as the general upper limit for alterations to buildings or vehicles, and compensation for losses resulting from injuries, as outlined in Schedule 4. Regulation 5 specifies that these amendments take effect from 1 November 1985. The Act imposes specific obligations on the Commonwealth Government to provide compensation benefits to employees who suffer injuries or fatalities while performing their duties. It requires the government to adhere to the updated rates and allowances as stipulated in the amended regulations. The government must ensure that all payments and benefits are calculated according to the new rates from the effective date of 1 November 1985. Violations of the provisions outlined in the Compensation (Commonwealth Government Employees) Regulations (Amendment) Statutory Rules 1985 No. 284 may result in civil or administrative penalties. The Act does not explicitly detail the penalties for non-compliance but indicates that breaches may lead to legal consequences. The maximum penalties are not explicitly stated in the provided text, but they would typically involve financial penalties or other corrective measures to ensure compliance with the updated compensation rates.
