Overview

The Torres Strait Fisheries Act 1984 was enacted to address the need for the sustainable management of fisheries within the Torres Strait, recognising the unique cultural and economic significance of fishing to the local communities. The Act was introduced by the Australian Parliament to provide a framework for the management of fisheries in the Torres Strait, including the protection of marine resources and the rights of local communities. This legislative instrument, the Torres Strait Community Fishing Notice No. 1, was made under the authority conferred by the Act and aims to implement specific regulations concerning community fishing activities in the area of Australian jurisdiction. The Notice was issued by the Hon Mark Vaile, the Commonwealth Minister for Agriculture, Fisheries and Forestry and Chairman of the Protected Zone Joint Authority, and it specifies the prohibition on taking fish without a licence, with certain exemptions for those holding appropriate licences. This Notice operates in conjunction with other Fisheries Management Notices, ensuring a comprehensive regulatory approach to managing fishing activities in the Torres Strait.

Scope and Application

The Torres Strait Community Fishing Notice No. 1 applies to individuals and entities engaged in community fishing activities within the area of Australian jurisdiction in the Torres Strait. It is an instrument made under the Torres Strait Fisheries Act 1984, which governs fishing practices in the region. The Notice specifically prohibits the taking, processing, or carrying of fish by community fishers without a valid licence. This prohibition is in line with the overarching purpose of the Act to regulate fishing activities in the Torres Strait and ensure sustainable practices. Notably, the Notice exempts individuals holding a licence granted under specific subsections of the Act from these prohibitions, thus allowing licensed community fishers to continue their activities. The Notice's jurisdictional reach is confined to the area of Australian jurisdiction within the Torres Strait, and it applies in conjunction with any other Fisheries Management Notices in force in the region.

Key Provisions

The Torres Strait Community Fishing Notice No. 1, made under section 17 of the Torres Strait Fisheries Act 1984, establishes specific regulations governing community fishing activities in the Torres Strait. The Notice (section 1) prohibits the taking, processing, or carrying of fish by individuals engaged in community fishing within the area of Australian jurisdiction unless they hold a licence issued under the Act. This prohibition is outlined in section 5 of the Notice, which aligns with paragraph 16(1)(a) of the Act. Entities and individuals affected by this Notice must comply with the requirements set out to engage in community fishing activities legally. Specifically, any person wishing to take, process, or carry fish must obtain the appropriate licence as specified in subsections 19(2) or 19(3) of the Act. These licences exempt the holder from the prohibitions outlined in section 5, as stipulated in section 6 of the Notice. Failure to adhere to these requirements can result in legal consequences, including potential penalties and enforcement actions. In terms of enforcement and penalties, the Notice does not explicitly state penalties for breaches of its provisions. However, breaches of the Torres Strait Fisheries Act 1984 and its associated regulations may incur penalties under the Act, which can include fines and imprisonment. The severity of penalties may depend on the nature and extent of the breach, as well as any relevant guidelines or regulations established under the overarching Act. Therefore, compliance with the Notice is crucial to avoid any adverse legal consequences.
