Overview

The Statutory Rules 1969 No. 0020, enacted under the Education Act 1945-1966, were introduced by the Governor-General, acting on the advice of the Federal Executive Council, to amend the Commonwealth Scholarships and Awards Regulations. This legislation was necessary to adjust the financial allowances for ordinary scholarships as part of a broader effort to ensure that scholarship recipients could adequately cover their living expenses during their studies. The objective of these amendments was to reflect the economic changes and cost of living adjustments that had occurred since the initial regulation was set, thus maintaining the value and relevance of the scholarship funds. The regulations, which came into effect from the beginning of 1969, specifically increased the allowance amounts to better support scholars. These amendments were made to ensure that the scholarship provisions remained in line with the policy objectives of supporting educational attainment and addressing economic disparities faced by students pursuing higher education. The changes were designed to support the ongoing educational needs of recipients while reflecting the current economic climate.

Scope and Application

These Statutory Rules, made under the Education Act 1945-1966, amend the Commonwealth Scholarships and Awards Regulations to adjust the amount of allowance for ordinary scholarships. The amendment specifically increases the allowance for students in the United Kingdom and Europe from four thousand six hundred dollars to five thousand dollars, and for students in other countries from two thousand three hundred dollars to two thousand five hundred dollars. These changes apply to the year starting on the first day of January, 1969, and all subsequent years. The scope of these Regulations is limited to the amendment of the scholarship allowances under the specified Act and does not extend to other areas of education or scholarship funding. The geographic reach of these amendments is national, as they pertain to Commonwealth scholarships and awards provided to students studying both within and outside Australia. The Regulations do not specify any exclusions, exemptions, or thresholds beyond the scope of the amended allowances, and they do not extend or restrict application through subordinate instruments.

Key Provisions

The main operative sections of the Statutory Rules 1969 No. 0020, made under the Education Act 1945-1966, involve amendments to the Commonwealth Scholarships and Awards Regulations, specifically Regulation 13. Regulation 13(3a) is amended to adjust the amounts of the allowances provided under ordinary scholarships. Specifically, the regulation modifies the maximum allowance from four thousand six hundred dollars to five thousand dollars, and the minimum allowance from two thousand three hundred dollars to two thousand five hundred dollars (section 1). These amendments apply to the year beginning on the first day of January 1969, and to all subsequent years (section 2). The obligations and requirements imposed by these Regulations are primarily concerned with the adjustment of financial allowances for ordinary scholarships under the Commonwealth Scholarships and Awards Regulations. The amended Regulation 13 now mandates that the maximum allowance for such scholarships be set at five thousand dollars, and the minimum allowance at two thousand five hundred dollars. This change is intended to reflect changes in the economic conditions or cost of living, ensuring that scholarship recipients receive adequate financial support. The application of these amendments is retrospective to the academic year that commenced on 1 January 1969, meaning that any scholarships awarded from that date forward are subject to the revised allowance amounts. There are no explicit provisions in these Regulations that outline specific offences, penalties, or civil/criminal consequences for breach. However, any failure to comply with the amended allowances could potentially result in legal challenges or administrative penalties under the broader framework of the Education Act 1945-1966. This could include actions taken by scholarship recipients who feel that they have not been appropriately compensated according to the new allowances, or by educational institutions that administer the scholarships and are required to adhere to the statutory regulations. Although the Regulations themselves do not specify penalties, any breaches of the Education Act could lead to enforcement actions as determined by the relevant authorities.
