Overview

The Statutory Rules 1957, No. 61, are Regulations under the Education Act 1945, enacted by the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council. This legislation aims to amend the Commonwealth Scholarship Regulations by adjusting the criteria for calculating student allowances. The problem these amendments seek to address is the need to ensure that scholarship recipients' financial support accurately reflects their actual living expenses, particularly by accounting for income received during the long vacation from non-employment sources and excluding income from employment during the same period. The policy objective is to provide a fair and accurate assessment of a student's financial situation to maintain the integrity and purpose of the scholarship program.

Scope and Application

The Statutory Rules 1957 No. 61, made under the Education Act 1945, pertain specifically to the amendments of the Commonwealth Scholarship Regulations. These regulations govern the financial allowances and income computations for students receiving Commonwealth scholarships, focusing on the adjustment of the amount of allowance and the exclusion of certain income during the long vacation period. The regulations apply to students who are recipients of Commonwealth scholarships, ensuring that their financial aid is appropriately calculated based on their income from non-employment sources during the long vacation. The amendments are designed to provide clarity and fairness in the financial support provided to scholarship recipients, ensuring that their scholarship allowances are not unduly affected by income fluctuations during the long vacation period. The changes made by these regulations are geographically and jurisdictionally limited to the Commonwealth of Australia, affecting all scholarship recipients within the national framework.

Key Provisions

The main operative sections of these Regulations involve amendments to the Commonwealth Scholarship Regulations under the Education Act 1945. Specifically, Regulation 13 is modified to change the method of calculating the allowance for students receiving Commonwealth scholarships, particularly during the long vacation (section 1). This amendment adjusts the threshold for income received from all sources other than employment, setting it at one pound ten shillings per week. Regulation 14 is further amended to specify that any income earned by a student from employment during the long vacation should be disregarded when calculating their overall income for the purposes of determining their allowance (section 2). These Regulations impose specific obligations on students receiving Commonwealth scholarships. Firstly, they must adhere to the new calculation method for their allowance during the long vacation, ensuring that their income from non-employment sources does not exceed the specified weekly limit. Secondly, students must accurately report their income, with earnings from employment during the long vacation excluded from the total income calculation. This requirement aims to ensure that the allowance provided reflects the students' financial needs accurately without being influenced by temporary employment income. Failure to comply with these Regulations could lead to penalties or other consequences, although the specific legal ramifications are not detailed in the text provided. Generally, breaches of educational regulations can result in the suspension or termination of the scholarship, along with potential administrative or legal actions. Given that these Regulations are made under the Education Act 1945, any violations might also be subject to the penalties outlined in that Act, although such details are not explicitly mentioned here. The precise penalties and enforcement mechanisms would typically be defined in the overarching legislation or additional regulatory frameworks.
