Overview

The Statutory Rules 1932, No. 95, made under the Commonwealth Bank Act 1911-1932, introduced amendments to the Commonwealth Savings Bank Regulations. Enacted by the Governor-General in Council, these amendments aimed to update the forms required for reporting the summary of business transactions and the balance sheets of the Commonwealth Savings Bank of Australia, reflecting the changing financial landscape of the time. The purpose was to ensure that the bank's operations were accurately and comprehensively reported, facilitating transparency and regulatory compliance. This legislative instrument sought to address the evolving administrative needs of the Commonwealth Savings Bank, ensuring that it remained efficient and effective in its operations.

Scope and Application

The Statutory Rules 1932, No. 95, which include amendments to the Regulations under the Commonwealth Bank Act 1911-1932, extend to the Commonwealth Savings Bank of Australia and affect the manner in which the bank must report its business transactions and financial status. These amendments specifically pertain to the forms and procedures required for summarising the business transacted during a quarter and for the presentation of the bank's balance sheet and profit and loss account. The changes involve modifications to Regulation 16 and Regulation 17, as well as the insertion of new forms B and C in the Schedule to replace the existing Forms B and C. The application of these amendments is national, as they apply to the Commonwealth Savings Bank of Australia, and thus affect the bank's operations across all states and territories within the Commonwealth. No exclusions, exemptions, or specific thresholds are mentioned in the text, suggesting that the amendments apply universally to the bank's reporting obligations. The scope of these amendments is further extended by the authority to create subordinate instruments, which may include additional forms or reporting requirements.

Key Provisions

The key provisions of these regulations, found in Regulation 16 (paragraph 1), involve amendments to the Commonwealth Savings Bank Regulations. Regulation 16 has been updated to include the phrase "or to the like effect" after the term "Form B", while Regulation 17 has been similarly amended with the same phrase following "Form C". These amendments aim to ensure that the bank's reporting forms remain effective and relevant. Under these regulations, the Commonwealth Savings Bank of Australia is mandated to provide detailed summaries of business transactions and statements of liabilities and assets for each quarter. This includes data on deposits, withdrawals, net results, interest credited to depositors’ accounts, and the total open accounts as of the date of the report (Regulation 16). Furthermore, the bank must detail its liabilities and assets, including depositors’ balances, cash on hand, government securities, and other relevant financial information (Regulation 17). Failure to comply with these regulations may result in various consequences, though specific penalties are not detailed within the provided text. However, the regulations set out a clear framework for financial reporting, and non-compliance could potentially lead to administrative or legal actions. The primary aim of these regulations is to ensure transparency and accuracy in the bank's financial reporting, thereby maintaining public trust and regulatory compliance.
