(a) No increments are provided in these grades. Salary within the limits of the grades will be such as may be determined from time to time by the Commissioner.

Notwithstanding anything contained in the foregoing, officers 21 years of age and over shall be paid salary at the rate of £110 per annum if occupying positions of Boy on Launch, Female Assistant (printing), Female Assistant (quarantine), Messenger, Pensions Receipt Sorter, Notes Sorter, or Telephonist, and at the rate of £126 per annum if occupying any other position in Grade I. or II. designated in the foregoing Schedule, but the payment of such salary under this provision shall not be taken into consideration for purposes of seniority or future advancement.

Except where otherwise provided advancement from grade to grade shall be dependent upon the occurrence of vacancies in the higher grades, or upon alteration of the classification of an office.

The grade of an officer under the provisions of this Regulation shall be that corresponding to his designation, provided that when the same designation occurs in two or more grades, the grade of the officer shall be that corresponding to the rate of salary received by him prior to the issue of this Regulation.

Notwithstanding anything in the Schedules contained in this Regulation in any case where the Governor-General, on the recommendation of the Commissioner, directs that an office shall be classified in any particular grade, the officer occupying such office may, subject to the approval of the Commissioner, be advanced to the minimum salary of such grade.

Overview

The Provisional Regulation under the Commonwealth Public Service Act 1902-1911 was enacted in 1913 to address the need for structured classification and remuneration within the Commonwealth Public Service. The regulation was issued by the Governor-General in Council, acting on the advice of the Federal Executive Council, and came into effect on 1 March 1913. The policy objective of this regulation was to establish a systematic framework for the arrangement of the General Division into grades, ensuring a clear delineation of roles and corresponding salary limits for various positions within the public service. This regulation replaced an earlier one and introduced a new structure, setting out the grades, minimum and maximum salaries, and conditions for salary increments and advancements, thereby providing a more organised and transparent approach to managing public service staff. The regulation also empowered the Governor-General, on the recommendation of the Commissioner, to create new offices and to adjust the grade and salary limits of existing offices, ensuring flexibility and responsiveness to the evolving needs of the public service. Additionally, it outlined the criteria for the advancement of officers within their respective grades, linking promotions to service duration and performance, while also considering the availability of vacancies in higher grades. This structured approach aimed to enhance efficiency and fairness in the public service by providing clear guidelines for salary management and career progression.

Scope and Application

This Provisional Regulation under the Commonwealth Public Service Act 1902-1911 establishes a structured grading system for the General Division of the Commonwealth Public Service. It applies to officers within the Commonwealth Public Service and sets out salary grades, increments, and conditions for advancement for various positions, including armourers, blacksmiths, detectives, engine drivers, and others. The regulation outlines the minimum and maximum salaries for each grade and provides specific details for different positions, such as annual increments and conditions for progression to higher grades. The regulation allows for the creation of new positions and the amendment of existing ones by the Governor-General, upon the recommendation of the Commissioner. While the regulation applies broadly to officers in the General Division, there are specific provisions for certain positions and grades, including special considerations for officers aged 21 years and over. The regulation does not specify any exclusions, exemptions, or thresholds, and its application may be extended or restricted through subordinate instruments as necessary.

Key Provisions

This Provisional Regulation, made under the Commonwealth Public Service Act 1902, establishes a new grading and salary structure for officers in the General Division of the public service. Regulation 104 replaces the previous regulation and details that officers are to be arranged in grades as specified in the First Schedule, with their respective salary limits set out in the Second Schedule. The Governor-General, on the recommendation of the Commissioner, is empowered to create new offices, assign them to a grade, and set their salary limits, or raise the grade and salary of an existing office. Any such changes are to be reflected in the Second Schedule. The Regulation imposes several obligations on the parties involved. The Commissioner must recommend any new office creation or changes to the Governor-General, who must then approve these recommendations. Officers are to be assigned a grade based on their designation and previous salary rate, and advancement to higher grades is contingent upon the availability of vacancies and changes in office classification. Certain officers are also subject to specific conditions for advancement, such as passing practical or telegraphic tests. Additionally, officers aged 21 and over are guaranteed a minimum salary based on their role, though this does not affect their seniority or future advancement prospects. Failure to comply with the provisions of this Regulation may result in various consequences. While the Regulation does not explicitly state offences or penalties for breaches, non-compliance could lead to disputes regarding salary, classification, and advancement, potentially resulting in administrative or legal challenges. The Governor-General and the Commissioner bear the responsibility of ensuring the Regulation's proper implementation and resolving any arising disputes.
