No increments will be granted in respect of positions classified in this grade; the salary of the officer to be fixed at a sum within the limits of the grade

Except where otherwise provided advancement from grade to grade beyond Grade V. shall be dependent upon the occurrence of vacancies in the higher grades, or upon alteration of the classification of an office, the duties of which have materially changed.

Notwithstanding anything contained in this Regulation, in any case where an increment to an officer would be deferred, owing to the provisions of the Regulation, beyond the date upon which it would have otherwise accrued, the Commissioner may grant the increment from such date.

The grade of an officer under the provisions of this Regulation shall be that corresponding to his designation, provided that any officer who is receiving at the date of this Regulation a salary less than the minimum amount of such grade, may be granted annual additions of salary of an amount to be determined by the Commissioner until the salary reaches such minimum.

Notwithstanding anything in the schedule contained in this Regulation in any case where the Governor-General, on the recommendation of the Commissioner, directs that an office shall be classified in any particular grade, the officer occupying such office may, subject to the approval of the Commissioner, be advanced to the minimum salary of such grade.

Overview

The Provisional Regulation under the Commonwealth Public Service Act 1902 was enacted in 1911 by the Governor-General in Council, acting on the advice of the Federal Executive Council, in response to an urgent need to restructure the grading and salary scales for officers in the General Division of the Commonwealth Public Service. This regulation was introduced to streamline the administrative framework and ensure that salaries were commensurate with the roles and responsibilities of the officers. The policy objective was to establish a clear, structured progression system for officers, which included specific criteria for increments and promotions based on service duration and efficiency. This Provisional Regulation aimed to replace the previous Regulation No. 104, which had become outdated and inefficient. It sought to provide a more detailed schedule of grades and corresponding salary limits for various positions, while also allowing for flexibility through the creation of new offices and adjustments in grading by the Governor-General on the recommendation of the Commissioner. The regulation underscored the importance of maintaining a fair and transparent system of remuneration and career progression within the public service.

Scope and Application

The Provisional Regulation under the Commonwealth Public Service Act 1902, as set forth in Statutory Rules 1911 No. 181, pertains to the arrangement of the General Division into distinct grades within the Commonwealth public service. This regulation applies to all officers in the General Division, detailing specific salary limits, increments, and advancement criteria for various positions based on their grade. The regulation allows for the creation of new offices or the adjustment of existing ones, with salary adjustments to be determined by the Governor-General upon the recommendation of the Commissioner. The regulation specifies minimum and maximum salaries for each grade, as well as the conditions under which increments may be granted and advancement achieved, ensuring that officers’ salaries and grades are consistent with their duties and experience. Notably, the regulation allows for certain officers to be paid higher salaries based on their age and efficiency, provided that such payments do not affect their seniority or future advancement prospects. The regulation is applicable across the Commonwealth of Australia, with its provisions enforceable throughout the nation.

Key Provisions

The main operative sections of this Provisional Regulation under the Commonwealth Public Service Act 1902 outline the arrangement of the General Division into various grades, specifying the minimum, maximum, and incremental salaries for each grade, along with conditions for salary adjustments and promotions (sections 1, 2, and 3). The schedule attached to these sections details the specific roles, minimum, maximum, and incremental salaries, and conditions for salary adjustments and promotions for each grade and role (Schedule). The Provisional Regulation imposes obligations on the parties it governs, such as the classification of officers into grades based on their roles and the determination of salaries according to the grade. It also requires officers to meet specific conditions for salary increments and promotions, such as passing efficiency tests or completing a certain period of service (sections 1, 2, and Schedule). The Governor-General has the authority to create new offices or raise the grading of existing offices, and the Commissioner has the authority to determine the salary of officers who are receiving less than the minimum amount of their grade and to approve promotions to higher grades (sections 1 and 3). Breach of the provisions of this Provisional Regulation may result in civil or criminal consequences, although the specific offences, penalties, or consequences are not explicitly stated in the text. However, the regulation does mention the authority of the Commissioner to grant salary increments and approve promotions, which implies that failure to comply with these provisions may result in the denial of such increments or promotions (section 3). The maximum penalties for any potential offences or breaches are not specified in the text.
