Overview
The Provisional Regulation under the Commonwealth Public Service Act 1902, enacted in 1908, was introduced to address the urgent need for adjustments in the pay scales for certain public service positions within the Commonwealth. The Commonwealth Public Service Act 1902 provided the legislative framework for the administration of the public service, and the regulation was necessary to implement immediate changes to the remuneration structure for specified roles. The regulation was made by the Governor-General in Council, acting on the advice of the Federal Executive Council, and it came into effect on 1 July 1907, highlighting the urgency of the amendments required. The policy objective was to ensure that the remuneration for public service officers was adjusted in a manner that was fair and reflective of the responsibilities and requirements of the positions.
Scope and Application
The Provisional Regulation under the Commonwealth Public Service Act 1902 applies to personnel within the Commonwealth public service, specifically targeting the roles within the Postmaster-General’s Department, particularly the Assistant, Senior positions. The regulation sets out the minimum and maximum yearly rates of pay, alongside the scale of additions for these positions, and establishes two distinct grades for Assistant, Senior roles, each with their own remuneration brackets. This regulation ensures that pay scales are clearly defined and adhered to within the specified department. The scope of this regulation extends nationally across the Commonwealth, impacting all federal public service employees within the outlined roles. However, it should be noted that this regulation is specifically tailored to the Postmaster-General's Department, and does not necessarily apply to other departments or roles outside of this scope.
Key Provisions
The legislative instrument, Statutory Rules 1908 No. 25, amends Regulation 104 of the Regulations under the Commonwealth Public Service Act 1902, effective from 1 July 1907. The amendment specifically alters the pay scale for Senior Assistants within the Postmaster-General's Department. Under the previous regulation, a Senior Assistant received a minimum yearly rate of £1146 and a maximum yearly rate of £2126, with increments every year. The new regulation introduces a dual-tier system: Senior Assistant Grade I continues to have a minimum yearly rate of £1146 and a maximum of £2126, with annual increments, while Senior Assistant Grade II sees a minimum yearly rate of £1326 and a maximum of £1138, also with annual increments.
The obligations imposed by this regulation on the relevant parties include the requirement to adhere to the new pay scales and increment structures for Senior Assistants. The Postmaster-General's Department must ensure that these changes are implemented correctly and that all applicable staff are appropriately compensated in line with their new grade classification. The regulation also imposes an obligation on the Department to maintain accurate records of these changes and to communicate them effectively to all relevant employees.
Failure to comply with the provisions of this regulation could result in administrative penalties. While the regulation itself does not specify particular penalties for non-compliance, breaches of the Commonwealth Public Service Act 1902 or its regulations can lead to disciplinary actions against public servants, up to and including termination of employment. Additionally, if the regulation is seen as affecting the fairness or legality of employment practices, it could potentially lead to legal challenges or reviews by industrial or employment tribunals. The precise consequences would depend on the specific nature and context of the breach.
