Overview

The Provisional Regulation under the Commonwealth Public Service Act 1902 was enacted in 1908 to address immediate administrative needs regarding the remuneration and conditions of public service positions. The regulation was certified by the Governor-General in the context of urgency, thereby allowing it to come into immediate effect to ensure efficient public service management. This legislative instrument was created to adjust the salary structure for specific roles within the public service, ensuring that compensation is aligned with the duties and responsibilities of the positions. The regulation was issued by the Governor-General with the advice of the Federal Executive Council, reflecting the government’s intent to promptly address these administrative gaps. The policy objective of this regulation was to provide a structured yet flexible approach to setting salaries within the public service, allowing for adjustments based on the workload and performance of employees.

Scope and Application

The Provisional Regulation under the Commonwealth Public Service Act 1902 applies to the officers within the Commonwealth public service, specifically addressing the remuneration for the office of Groom-in-charge within the Postmaster-General's Department. The regulation aims to provide specific minimum and maximum yearly rates of pay and outlines a structured scale of additions based on performance intervals. The regulation is framed to ensure that salaries within the specified range are adjusted by the Commissioner, reflecting the duties performed. The regulation operates within the Commonwealth jurisdiction, affecting federal public service roles and remuneration standards. There are no explicit exclusions mentioned within this provisional regulation, but it is noted that the specifics of the pay scale adjustments are subject to the discretion of the Commissioner and the performance of the role. The regulation is an immediate provisional measure, intended to be followed by further formal amendments or regulations as deemed necessary by the Commonwealth authorities.

Key Provisions

The key operative sections of the Provisional Regulation under the Commonwealth Public Service Act 1902 (C1908L00038) primarily focus on amending the salary scales for the office of Groom-in-charge within the Postmaster-General's Department. Specifically, Regulation 104 is amended to adjust the minimum, scale of additions, and maximum yearly rates of pay for the Groom-in-charge (section 1(a) and (b)). The amendment involves removing the previous details and inserting new parameters for the role. The amended regulation specifies a minimum yearly rate of pay of £120 for the Groom-in-charge, with maximum yearly rates reaching £138, depending on the scale of additions. The new scale of additions is set at £3 per year, payable at intervals of not less than one year. This amendment effectively establishes a more defined and incremental pay structure for the position, ensuring that salaries are more systematically determined based on performance and tenure. The obligations imposed by this regulation primarily concern the Postmaster-General's Department, which must adhere to the newly set pay scales for the Groom-in-charge. The department is responsible for ensuring that the pay adjustments are correctly implemented and that employees are compensated according to the specified minimum and maximum rates. Additionally, the Commissioner is tasked with fixing salaries between the minimum and maximum rates based on the work performed by each Groom-in-charge. Failure to comply with the provisions of this regulation may result in administrative or legal consequences. Although the specific penalties for non-compliance are not detailed in the text, breaches of public service regulations generally attract penalties that could include fines, corrective actions, or further legal proceedings. The exact penalties would depend on the nature and severity of the breach, as well as the relevant provisions of the Commonwealth Public Service Act 1902 and other applicable laws.
