Overview

The Statutory Rules 1908 No. 83, titled "Provisional Regulation Under the Commonwealth Public Service Act 1902," was enacted to establish a structured grading system within the General Division of the Commonwealth Public Service, thereby addressing the need for a more organised and systematic approach to public service roles and remuneration. This Provisional Regulation was issued by the Governor-General in Council, highlighting the urgency and significance of the changes. The regulation sought to provide clarity and consistency in the classification of public service roles by replacing and updating previous regulations. The overarching policy objective was to create a fair and transparent framework for the remuneration and progression of public servants, ensuring their roles and salaries were commensurate with their responsibilities and experience.

Scope and Application

The Provisional Regulation under the Commonwealth Public Service Act 1902 applies to officers within the General Division of the Commonwealth Public Service. This includes various positions across different grades and offices, as specified in the regulation. The regulation sets out a detailed schedule of grades, minimum and maximum salaries, and annual increments for each position. The regulation also provides for the creation of new offices and the fixing of grades for officers in such positions, with the Governor-General having the authority to make these determinations upon the recommendation of the Commissioner. The regulation is effective across the Commonwealth of Australia and its application is subject to the overarching provisions of the Commonwealth Public Service Act 1902. Subordinate instruments may extend or restrict the application of this regulation as necessary.

Key Provisions

The key provisions of the Provisional Regulation under the Commonwealth Public Service Act 1902 (C1908L00083) establish a new salary structure for the General Division of the public service. The regulation replaces earlier regulations 96, 100, 103, and 104, and sets out a new schedule of grades and corresponding salaries (Section 104). Each grade has a specified minimum and maximum salary, along with annual increments. The Governor-General has the authority to create new positions and determine their grade based on the Commissioner's recommendation. The regulation imposes obligations on various parties, including the Commissioner, who must ensure that officers are placed in the appropriate grade based on their duties and efficiency. Officers themselves must meet certain service and age requirements to qualify for specific salary levels. Furthermore, officers who have completed significant service may be eligible for long service increments, provided they meet the good conduct and efficiency criteria outlined in the regulation. Breaches of the provisions within this regulation could lead to civil or administrative penalties, though the regulation does not explicitly outline these consequences. However, the context suggests that non-compliance with the salary structure or advancement criteria could potentially result in disputes over salary and grade placement, which might need to be resolved through administrative review or legal action. The regulation does not specify maximum penalties, but the seriousness of the breach would dictate the extent of the consequences.
