Overview

The Statutory Rules 1934 No. 37, Regulations under the Commonwealth Public Service Act 1922-1933, were introduced to refine and expand the existing framework governing the Commonwealth Public Service. Enacted by the Board of Commissioners in accordance with their authority under the Commonwealth Public Service Act, these regulations were subject to the approval of the Governor-General, Isaac A. Isaacs, and subsequently approved by Executive Council on March 23, 1934. The purpose of these regulations was to amend existing provisions concerning the salaries and roles within the Commonwealth Public Service, thereby ensuring that the public service could effectively and efficiently meet the nation's administrative needs. The regulations introduced adjustments to the salary scales, roles, and responsibilities of various positions within different departments and branches, aiming to enhance the operational efficiency and remuneration structures within the public service.

Scope and Application

The Regulations under the Commonwealth Public Service Act 1922-1933 provide specific amendments to the Commonwealth Public Service Regulations. They apply to various offices and positions within the Commonwealth Public Service, detailing salary minimums, maximums, and annual increments for specified roles. The regulations affect entities and individuals within the Commonwealth Public Service across different departments and branches, including the Postmaster-General's Department, the Health Department, and the Interior Department. The geographic reach of these regulations is national, as they apply uniformly across the Commonwealth of Australia, affecting public servants in various states such as New South Wales, Tasmania, Queensland, and South Australia. There are no stated exclusions or exemptions within the provided text, and the application of these regulations is direct without the need for further extension or restriction through subordinate instruments. The amendments to the salary scales and the introduction of new positions reflect an effort to adjust and expand the public service structure to better meet the needs of the Commonwealth at the time.

Key Provisions

The Regulations under the Commonwealth Public Service Act 1922-1933, as outlined in Statutory Rules 1934, No. 37, introduce amendments to the existing Commonwealth Public Service Regulations. The amendments primarily affect the salary scales and roles within various departments and branches of the Commonwealth Public Service. For example, Regulation 104 adds new positions such as Deputy Commissioner (Sales Tax) in Canberra, with salary ranges specified (Section 1(a) and (b)). Regulation 106 further details new roles, including Assistant (Statistics), Senior, within the Postmaster-General’s Department, New South Wales, along with specific salary increments and conditions (Section 1(a), (b), (d), (e), (f), (g), (h), (i), (j), (k), and (m)). These amendments impose specific obligations on the departments and branches affected, primarily concerning the creation of new positions and the adjustment of salary scales. Departments must ensure that new roles are filled in accordance with the specified salary ranges and conditions, such as the requirement for passing a test and completing an approved course of study for the Mechanic (Observatory) position (Section 1(e)). Additionally, departments must update their records to reflect the removal of certain positions and the addition of new ones, as outlined in the regulations. Failure to comply with these amendments could result in operational inefficiencies and potential disputes over salary and role definitions. However, the regulations themselves do not explicitly outline specific penalties for non-compliance. Instead, the overarching Public Service Act and other relevant legislation would govern the consequences of not adhering to these amendments, which could include disciplinary actions or administrative penalties as determined by the relevant authorities.
