Overview

The Commonwealth Public Service Act 1922-1928 was enacted by the Australian Parliament to provide a structured framework for the administration of public service employees within the federal government. This legislation was introduced to address the need for a comprehensive and consistent system to manage the employment, remuneration, and conditions of public service officers across various divisions. The Act aimed to ensure efficiency, fairness, and accountability in the federal public service. The Board of Commissioners, exercising its authority under the Act, subsequently made amendments to the Commonwealth Public Service Regulations through Statutory Rules 1926, No. 212, as amended, to further refine and update the salary scales and conditions of service for public servants. The policy objective was to establish a well-regulated and equitable public service that could effectively meet the administrative needs of the nation.

Scope and Application

The Regulations under the Commonwealth Public Service Act 1922-1928 apply to officers within the Third and Fourth Divisions of the Commonwealth Public Service. The Third Division comprises those officers whose salaries are fixed within certain limits specified by the Governor-General on the recommendation of the Board of Commissioners. The Fourth Division includes officers whose salaries are determined by specific scales or amounts as shown in designated tables or by the Governor-General on the Board's recommendation. These regulations establish the salary limits and increments for male and female officers, with different minimum rates for officers under 21 years of age, and ensure that female officers receive a salary fifty pounds less than their male counterparts unless otherwise specified. The geographic reach of these regulations is national, applying across all states and territories in Australia. The regulations do not specify any exclusions or exemptions, thus applying broadly to all officers within the specified divisions. The application of these regulations can be further extended or modified through subordinate instruments as authorised by the Act.

Key Provisions

The Statutory Rules 1930, No. 3, made under the Commonwealth Public Service Act 1922-1928, introduce amendments to the Commonwealth Public Service Regulations, effective immediately upon their creation (regulation 1). These amendments notably revise the salary structures for officers in the Third and Fourth Divisions of the public service. Regulation 105 replaces the existing regulation by setting salary limits for officers in the Third Division, specifying that these limits are to be determined by the Governor-General based on the Board’s recommendations, with reference to tables A and B (regulation 105(1)). The regulation also allows for salary increments within these limits, provided they adhere to section 31 of the Act and subsequent regulations (regulation 105(2)). It further outlines minimum pay rates for officers aged 21 years and under, distinguishing between male and female officers, and imposes a minimum salary threshold for all officers (regulation 105(3)). The obligations imposed by these regulations include the requirement for the Board to recommend salary limits to the Governor-General, who must then approve these limits. The Board is also tasked with monitoring adherence to the specified salary scales and increments, ensuring that all officers receive remuneration in accordance with the regulations. Additionally, the Board must ensure that any newly created offices or those undergoing changes in designation are appropriately classified and compensated as per the regulations (regulation 106(2)). The Statutory Rules impose penalties and consequences for non-compliance with these regulations. While specific penalties are not detailed within the text, breaches of public service regulations typically result in disciplinary actions against the offending officers, which may include fines, suspension, or termination of employment. These actions are usually governed by the broader public service laws and regulations, which may provide for additional penalties such as monetary fines or legal action for serious breaches.
