Notwithstanding anything contained in this regulation, if the rate of pay prescribed for an office named in this Table is less in any case than the rate determined by Arbitration Court or Wages Board to be paid for similar employment in the locality of employment, upon approval of the Commissioner, remuneration corresponding to the latter rate may be paid in respect of such office instead of the salary prescribed in this Table.

2. Regulations 104a and 104E of the Public Service Regulations are repealed.

3. Regulation 168b of the Public Service Regulations is amended by omitting therefrom the figures “£96” and inserting in their stead the figures “£114.”

Overview

The Commonwealth Public Service Regulations (Fourteenth Amendment 1921) was enacted to address gaps in the existing structure and grading of salaries within the Commonwealth Public Service. This amendment was made under the Commonwealth Public Service Act 1902-1918, and it was introduced to bring the salary structure of the public service into alignment with the economic conditions of the time. The policy objective of this amendment was to provide a more structured and fair remuneration system for public service officers. The Regulations were made by the Governor-General in Council, acting on the advice of the Federal Executive Council, and they came into operation from 1 July 1921. This amendment primarily focuses on the grading of salaries and the corresponding minimum and maximum salaries for various positions within the public service, with specific provisions for increments and conditions for advancement.

Scope and Application

The Commonwealth Public Service Regulations (Fourteenth Amendment 1921) applies to officers within the General Division of the Commonwealth Public Service. These regulations are established under the Commonwealth Public Service Act 1902-1918 and are intended to define the grades, salary limits, and conditions for various positions within the public service. The scope of the Act includes the creation and adjustment of offices, grade placements, and salary limits, which are to be determined by the Commissioner upon recommendation from the relevant authorities. This legislation provides a structured framework for the remuneration and progression of public service officers, ensuring that their roles and responsibilities are matched with appropriate salary scales and career advancement opportunities. The amendment introduces new salary scales and modifies existing ones to align with the current economic conditions and public service requirements. The application of these regulations is comprehensive across the Commonwealth, affecting all officers within the designated divisions and grades.

Key Provisions

The Commonwealth Public Service Regulations (Fourteenth Amendment 1921) primarily amend the existing salary structure for various positions within the General Division of the Commonwealth Public Service. Regulation 104, which outlines the grades of the General Division, is replaced with a new structure specifying different salary grades (from I to X) with corresponding minimum and maximum salaries (section 1). The amendment also details the specific salary limits, increments, and conditions for advancement for numerous positions, such as Armourer, Artificer, Inspector, and others, listed in Tables B and C (section 1). Additionally, Regulation 168b is modified to change the salary figure from £96 to £114 (section 3). These amendments impose specific obligations on both the officers within the Commonwealth Public Service and the Commissioner. Officers must adhere to the newly defined salary grades and conditions for advancement as specified in Tables B and C. The Commissioner, on the other hand, has the authority to create new positions, adjust salary grades and limits, and determine salaries for positions not explicitly defined in the tables, upon recommendation from the Commissioner (section 1(3)). Failure to comply with these regulations may result in legal consequences. However, the specific offences, penalties, or civil/criminal consequences for breaches are not detailed within the provided text. The text focuses on the structural amendments to the salary grades and conditions without addressing enforcement measures or penalties for non-compliance.
