Overview

The Statutory Rules 1910, No. 81, enacted under the Commonwealth Public Service Act 1902-1909, addresses the need to update and clarify regulations concerning the provision of assurance policies for public servants. This legislative instrument was introduced to ensure that public servants receive adequate life assurance coverage that aligns with their salaries and roles. The regulation was made by the Governor-General in Council, with the aim of maintaining orderly and efficient public service administration by providing clear guidelines for assurance policies. The policy objective is to ensure that public servants, or their beneficiaries, receive appropriate compensation in the event of death or reaching the age of retirement, thereby providing financial security and stability to their families.

Scope and Application

The regulation pertains to the Commonwealth Public Service Act 1902, specifically concerning the insurance policies for public servants. It applies to all individuals who are not already assured under any policy, ensuring that these individuals must take out a policy that provides for a payment upon reaching the age of 60 or to their personal representatives if they pass away before that age. The regulation sets forth a specific scale for the amount of assurance based on the maximum salary of the class or position to which the officer is appointed or promoted. For instance, an officer with a maximum salary of up to £150 would have an assurance of £150, with incremental increases for higher salary brackets, culminating in an assurance of £500 for those earning over £400. In exceptional cases, the Commissioner may allow for an assurance to be payable at age 65. This regulation is applicable across the Commonwealth, enforcing a uniform standard for insurance coverage among public servants. There are no exclusions or exemptions mentioned within the regulation itself, though it does provide for special circumstances under which an officer may be permitted to effect an assurance payable at 65 years of age.

Key Provisions

The regulation, numbered 172, under the Commonwealth Public Service Act 1902-1909, outlines specific provisions concerning the payment of an assured amount to a person or their representatives. This regulation mandates that any policy taken out by an individual not already insured must provide for a payment based on a scale determined by the maximum salary of the class or position to which the officer is appointed or promoted. For instance, if an officer’s salary falls under £150, the assured amount is £150; if it exceeds £150 but is under £200, the assured amount increases to £200, and so forth (Reg 172). The payment is due upon the person reaching 60 years of age or to their personal representatives if they pass away before reaching that age. In exceptional cases, the Commissioner has the authority to allow an officer to secure an assurance payable at 65 years of age. Under this regulation, there are explicit requirements and obligations imposed on the parties involved. The regulation demands that every policy taken out must comply with the specified scale of payments and be executed within the stipulated timeframe. This ensures that the financial security for the assured person or their representatives is managed according to the officer’s salary bracket. Additionally, the regulation mandates that the payment must be made within three months from the date of death if the assured person passes away before reaching 60 years of age. These provisions are designed to provide a systematic and equitable approach to the assurance payments within the public service framework. Failure to adhere to the stipulations outlined in Regulation 172 could result in various consequences. While the regulation does not explicitly state any penalties for non-compliance, it is reasonable to infer that breaches could lead to administrative or disciplinary actions as per the overarching provisions of the Commonwealth Public Service Act 1902-1909. Such actions could include revocation of benefits, financial penalties, or other corrective measures deemed necessary by the relevant authorities to ensure compliance with the regulation. The absence of explicitly stated penalties suggests a reliance on broader legal frameworks to enforce adherence to these assurance payment provisions.
