Overview

The Statutory Rules 1926, No. 160, represent amendments to the Commonwealth Public Service Regulations made under the authority of the Commonwealth Public Service Act 1922-1924. Enacted by the Board of Commissioners, these amendments were subject to the approval of the Governor-General and aimed to address the need for updating salary scales and employment conditions for certain positions within the Commonwealth Public Service. The legislative instrument was approved in the Executive Council and signed by the Governor-General on 17 November 1926. The overarching policy objective of these amendments was to ensure fair compensation and professional development pathways for public service employees, thereby maintaining an efficient and skilled public service workforce.

Scope and Application

The Statutory Rules 1926 No. 160, Regulations under the Commonwealth Public Service Act 1922-1924, outlines amendments to the Commonwealth Public Service Regulations, affecting specific positions within the Department of Works and Railways and the Lands and Surveys Branch. These amendments specify salary scales, with certain roles such as the Director of the Lands and Surveys Branch and various positions within the Department of Works and Railways, including Draftsmen, having their pay rates adjusted. Furthermore, these Regulations impose conditions for salary increments, stipulating that certain officers must complete approved courses of study to qualify for higher pay rates. The amendments are applicable to employees within the Commonwealth Public Service, specifically those within the outlined departments and positions, and are subject to the approval of the Governor-General. These amendments are part of a broader set of regulations designed to govern the public service of the Commonwealth of Australia, ensuring that the public service operates efficiently and effectively.

Key Provisions

The primary sections of the Statutory Rules 1926, No. 160, are those that amend the Commonwealth Public Service Regulations (Regulations) under the Commonwealth Public Service Act 1922-1924. Regulation 104 has been amended to include the Director, Lands and Surveys Branch, with specified salary increases effective from 1 July 1926 (Section 1). Regulation 105a has been expanded to include two new paragraphs (v and w) that detail salary limits and conditions for advancement for Draftsmen within the Department of Works and Railways (Section 1). Lastly, Regulation 106 has been amended by adding a new table (Table G) with details of salary increments for various positions in the Lands and Surveys Branch, effective from 1 July 1926 (Section 1). The obligations imposed by these amendments include adherence to the newly established salary scales for the Director, Lands and Surveys Branch, and for Draftsmen in the Department of Works and Railways. For Draftsmen, there are specific educational requirements that must be met for salary advancement, as outlined in paragraph (v) of Regulation 105a. Furthermore, the amendments require the Board to evaluate the character and importance of the work as well as the capability of the Draftsman before any salary advancement beyond the specified limits, as stated in paragraph (w) of Regulation 105a. There are no explicit offences, penalties, or civil/criminal consequences mentioned in the text for breach of these regulations. However, it can be inferred that failure to comply with the specified conditions for salary advancement could result in non-compliance with the stipulated requirements, potentially leading to administrative or disciplinary action within the public service framework. The maximum penalties, if any, would be determined by the internal policies and procedures of the Commonwealth Public Service, rather than explicitly stated within these Regulations.
