Overview
The Statutory Rules 1936, No. 88, under the Commonwealth Public Service Act 1922-1934, were enacted to amend the Commonwealth Public Service Regulations with respect to the qualifications required for certain office positions within the public service. These regulations were introduced to address the need for specific qualifications and age limits for the transfer or promotion of officers to various roles, ensuring that those in public service positions meet certain standards. The Board of Commissioners, in exercise of the authority conferred by the Act and subject to the approval of the Governor-General, made these regulations on 19 June 1936. This legislative instrument aims to maintain a competent and qualified public service by imposing qualifications and age limits for specific offices, thereby enhancing the efficiency and effectiveness of public service operations.
Scope and Application
The Statutory Rules 1936 No. 88, made under the Commonwealth Public Service Act 1922-1934, outlines amendments to the Commonwealth Public Service Regulations, particularly focusing on the qualifications required for certain offices. This legislation applies to officers within the Commonwealth public service who are seeking transfer or promotion to specific positions listed within the regulations. These positions include roles such as Apprentice, Architect, Draftsman, Engineer, Mechanic, Mail Officer, Postmaster, and various supervisory and technical positions within postal, telegraph, and telephone services. The regulation mandates that such officers must pass a test or examination determined by the Board and be within the age limits specified for these tests. The geographic and jurisdictional reach of this Act is limited to the Commonwealth, impacting federal public service employees across Australia. There are no stated exclusions or exemptions within the text, and the application is direct without extension through subordinate instruments.
Key Provisions
The primary operative sections of these regulations, as set forth in Statutory Rules 1936 No. 88, primarily involve amendments to the Commonwealth Public Service Regulations, specifically altering the qualifications for certain offices. Regulation 112a(1) has been repealed, with a new sub-regulation replacing it (1). This new sub-regulation stipulates that the transfer or promotion of an officer to a specified list of positions will be contingent upon passing a test or examination determined by the Board and meeting the age limits set for that test or examination. The offices subject to these changes include Apprentice Architect, Cadet Biochemist, Draftsman Cadet, Draftsman Engineer, Engineer Cadet, and many others, including Mechanic, Junior Mechanic, Senior Mechanic, Monitor, Motor Car Driver, Motor Mechanic, Postal Assistant, Grades 2 and 3, Postal Clerk, Postmaster, Senior Postal Clerk, Supervisor, Mail Branch, Supervisor, Telegraph, Supervisor, Telephone, Telegraphist, Telephonist, Traffic Officer (Telephones), and Typist.
These regulations impose specific obligations and requirements on public service officers who seek transfer or promotion to the listed positions. Primarily, these officers must pass a test or examination that is periodically determined by the Board. Additionally, they must fall within the age limits stipulated as a condition of the test or examination. This ensures that only qualified and appropriately aged individuals can be promoted or transferred into these positions, maintaining a high standard of competency and suitability within the public service.
Failure to meet the requirements set out in these regulations can result in various consequences. Although the specific civil or criminal penalties for non-compliance are not detailed within the text, it is reasonable to infer that any breaches of these requirements could lead to disciplinary action, including potential termination of employment or other sanctions deemed appropriate by the Board. The regulations underscore the importance of adhering to the qualifications and age limits set forth to maintain the integrity and efficiency of the public service.
