Overview
The Statutory Rules 1931, No. 29, titled "Regulations Under the Commonwealth Public Service Act 1922-1930," was introduced to amend the Commonwealth Public Service Regulations. Enacted by the Board of Commissioners under the authority of the Commonwealth Public Service Act 1922-1936, these regulations were subsequently approved by the Governor-General, Sir Isaac Isaacs, and came into effect immediately. The objective of these amendments was to revise the conditions of employment for certain positions within the public service, specifically addressing the progression of staff from junior to adult positions upon reaching the age of 21 and the corresponding salary adjustments. This legislative instrument aimed to provide clarity and consistency in the public service employment framework, ensuring that employees in designated roles receive appropriate remuneration and career advancement opportunities.
Scope and Application
The Statutory Rules 1931, No. 29, pertains to amendments of the Regulations under the Commonwealth Public Service Act 1922-1936. This legislative instrument applies to employees within the Commonwealth Public Service who hold specific positions, namely Messenger, Launch Boy, Junior Assistant, Telephonist (Male), and Telegraph Messenger. The amendments concern the transition of these employees from their current roles to adult positions upon reaching the age of 21, with a corresponding salary adjustment to £204 per annum. The changes are applicable across the Commonwealth, reflecting the federal scope of the Act. The application is direct and specific, with no stated exclusions or exemptions within the provided excerpt. The regulations are to come into operation immediately upon approval by the Governor-General, which was granted on the thirteenth day of March, 1931. The Board of Commissioners' amendments are subject to the overarching authority of the Commonwealth Public Service Act, indicating that further modifications may be introduced through subordinate instruments as needed.
Key Provisions
The primary amendments outlined in this statutory instrument (Reg. 106) pertain to the transition of certain positions from youth to adult roles within the Commonwealth Public Service. Specifically, these changes affect the offices of "Messenger," "Launch Boy," "Junior Assistant," "Telephonist (Male)," and "Telegraph Messenger." According to the new regulations, individuals holding these positions who reach the age of 21 will be entitled to a salary of £204 per annum and will be eligible for transfer to an adult position when a suitable vacancy arises (Reg. 106(a), (b), (c)).
These amendments impose obligations on both the employees and the Board of Commissioners. Employees in the specified roles are required to continue their service until they reach the age of 21, at which point they must be compensated at the rate of £204 per annum and be considered for transfer to an adult position. The Board of Commissioners, on the other hand, must ensure that these changes are implemented effectively and fairly, maintaining transparency and adherence to the new salary and transition provisions outlined in the regulations.
Failure to comply with these amendments could result in various consequences. While the statutory instrument does not explicitly detail penalties for non-compliance, breaches of public service regulations typically result in disciplinary action, including potential termination of employment, fines, or other administrative penalties. Given the nature of the amendments, any failure to follow these new provisions could be considered a breach of employment terms and conditions, leading to such consequences as deemed appropriate by the Board of Commissioners.
In summary, the statutory instrument makes significant changes to the transition process for youth positions within the Commonwealth Public Service, ensuring that employees who reach the age of 21 are compensated appropriately and considered for adult roles. The Board of Commissioners is tasked with enforcing these changes, and non-compliance could result in serious administrative and disciplinary consequences for the employees involved.
