Overview

The Commonwealth Public Service Regulations 1927 are amendments to the existing Commonwealth Public Service Regulations under the authority of the Commonwealth Public Service Act 1922-1924. Enacted by the Board of Commissioners, these regulations aim to adjust and refine the existing framework governing the pay and conditions of public service officers, including variations of salary, allowances, and increments. The amendments address specific issues such as the introduction of new allowances for officers with dependent children and adjustments to salary scales and increments for various positions. These changes reflect an effort to better support public servants and their families while ensuring a fair and structured progression within the public service hierarchy. The policy objective is to maintain an efficient and equitable public service system that recognises the contributions of public servants and supports their professional development.

Scope and Application

The Statutory Rules 1927, No. 140, which comprise the Regulations Under the Commonwealth Public Service Act 1922-1924, pertain to the governance and management of the Commonwealth Public Service in Australia. The Board of Commissioners, established under the Commonwealth Public Service Act, has been authorised to make amendments to the existing regulations to enhance the administration and operation of the public service. These amendments apply to all officers within the Commonwealth Public Service, including those within the Second, Third, and Fourth Divisions. The changes cover a range of aspects, from salary variations and allowances to conditions of employment, advancement, and increments. The amendments specify new salary scales, allowances for officers with dependent children, and adjustments for officers receiving certain increments. Notably, these regulations apply across the Commonwealth and are subject to the approval of the Governor-General. The specific details of these amendments are laid out in the tables and sub-regulations, providing a structured approach to the salary structure and employment conditions within the public service.

Key Provisions

The amendments to the Commonwealth Public Service Regulations primarily introduce changes to the salary structures and allowances for officers within the public service, particularly focusing on the officers in the Second, Third, and Fourth Divisions. These amendments also include provisions for variation of salary, allowances for dependent children, and adjustments to salary based on the officer's family responsibilities and service conditions. For example, Regulation 2 introduces a new part, "Variation of Salary—Officers of Second, Third, and Fourth Divisions," which allows for adjustments to salaries based on the officer's family situation and the number of dependent children. Regulation 86 now provides an allowance for officers who have children under fourteen years of age, or orphan or adopted children under fourteen years, and whose annual salary is less than £500. Additionally, Regulation 105 introduces a new clause (v) to paragraph (b) of sub-regulation (4), increasing the salary of officers receiving £1,000 or more by £50. The amendments impose various obligations on officers and the Board of Commissioners. Officers are required to maintain certain conditions to be eligible for salary increments and transfers between divisions. For instance, Regulation 105a specifies that officers receiving £402 per annum or more are ineligible for further incremental advancement unless specified otherwise. Similarly, Regulation 112 mandates that officers must meet certain age criteria and pass examinations to be eligible for transfer from the Fourth to the Third Division. The Board, on the other hand, is responsible for determining and notifying the conditions for salary variations, allowances, and increments, as well as the eligibility criteria for officers. Breaches of these regulations may result in penalties or other consequences. While specific penalties are not detailed in the amendments, it is implied that non-compliance with the stipulated conditions for salary increments, allowances, and transfers could lead to administrative penalties or disqualification from certain benefits. The regulations emphasize that no officer shall be granted an increment that places them in a more favourable position than if they had served the entire period on the permanent staff. This suggests that any attempt to manipulate service conditions for personal gain could be met with corrective measures.
