Overview

The Statutory Rules 1927, No. 87, titled "Regulations under the Commonwealth Public Service Act 1922–1924," were enacted to amend the Commonwealth Public Service Regulations. These amendments were made by the Board of Commissioners, appointed under the Commonwealth Public Service Act, with the approval of the Governor-General, and came into effect immediately except for Regulation 90, which took effect from 1 August 1927. The purpose of these regulations was to address various issues related to public service operations, including adjustments to motor vehicle allowances, salary updates for certain positions, and modifications to office listings and salary tables. The amendments reflect the evolving needs of the public service and aim to ensure fair and efficient administration within the Commonwealth Public Service.

Scope and Application

The Statutory Rules 1927, No. 87, issued under the Commonwealth Public Service Act 1922-1924, establish amendments to the Commonwealth Public Service Regulations, which primarily govern the administrative framework, salaries, and allowances for public service officers within the Commonwealth. These regulations apply to public service officers employed by the Commonwealth government and encompass various departments and offices, as evidenced by the amendments to salary scales and positions outlined in the document. The amendments affect the remuneration of officers and the criteria for allowances, specifically modifying the rates for motor vehicle allowances and introducing new positions or adjusting existing salary scales for certain offices. These regulations have a national jurisdictional reach, impacting the federal public service across Australia. The document specifies adjustments to various allowances and salaries, indicating a comprehensive update to the financial provisions for public service employees. The amendments include modifications to motor vehicle allowances, changes to salary scales for specific offices, and the introduction of new positions, such as the Clerk in the Pensions and Maternity Allowances Branch in Western Australia. The amendments are designed to bring the regulations up to date, reflecting changes in the public service structure and financial provisions. The amendments also refine the geographic scope by removing certain locations from the list of eligible areas for specific allowances, thereby fine-tuning the application of these regulations to the Commonwealth public service.

Key Provisions

The legislative instrument, Statutory Rules 1927, No. 87, amends the Commonwealth Public Service Regulations under the Commonwealth Public Service Act 1922-1924. Regulation 90 is amended to change the reimbursement rates for mileage of various types of vehicles used in public service duties. Specifically, it modifies the rates for motorcars based on their horsepower and other vehicles such as motor cycles and bicycles (Reg. 90). Regulation 104 is amended to adjust the salary scales for certain public service positions effective from 1 July 1926, including Assistant Secretary and Official Secretary to the Governor-General, and introduces new positions such as Chief Inspector (Finance) and Chief Inspector (Postal Services) (Reg. 104). Regulation 105B introduces a new position, Clerk in the Pensions and Maternity Allowances Branch in Western Australia, with a salary range (Reg. 105B). Regulation 105C removes specific locations from the list of approved places for certain services, such as Albury and Fowler's Bay (Reg. 105C). Regulation 106 makes several amendments to salary scales and job classifications, including the introduction of new positions such as Senior Assistant (Permits, &c.), Industrial Registrar’s Office, and adjustments to existing positions' salary scales and increments (Reg. 106). The amended regulations impose obligations on public service employees and departments to adhere to the new rates and salary scales. Employees must ensure they are reimbursed correctly according to the new mileage rates, and departments must update their payroll systems to reflect the new salary scales. Additionally, departments must ensure that their staffing aligns with the newly introduced positions and their respective duties and responsibilities. Public service employees are required to pass certain tests for promotions or to be eligible for higher pay rates, with exceptions granted based on conduct, diligence, and efficiency (Reg. 106(h)). Failure to comply with these regulations may result in incorrect reimbursements for mileage or salary discrepancies. While the legislative instrument does not explicitly outline penalties for non-compliance, breaches of public service regulations can typically lead to disciplinary actions under the Commonwealth Public Service Act. These may include fines, deductions from salary, or other administrative penalties as determined by the Board of Commissioners. The maximum penalties are not specified within the text of this legislative instrument but are generally aligned with the provisions of the primary act and other relevant regulations.
