Overview

The Statutory Rules 1948, No. 49, under the Commonwealth Public Service Act 1922-1947, were enacted to amend the Commonwealth Public Service Regulations. These regulations were introduced to address the need for establishing qualifications and conditions for officers in research roles within the public service. The Public Service Board, acting under the authority conferred by the Commonwealth Public Service Act, made these amendments to ensure that officers in research positions meet specific academic and professional standards. The policy objective of these amendments is to maintain high standards of competency and capability in research roles within the public service, ensuring that officers are suitably qualified and capable of undertaking their duties effectively.

Scope and Application

The Regulations under the Commonwealth Public Service Act 1922-1947, specifically Statutory Rules 1948, No. 49, pertain to amendments within the Commonwealth Public Service Regulations, governing the qualifications and conditions of advancement for officers within the public service. These amendments introduce and modify the criteria for officers aspiring to roles such as Research Officers, Grades 1, 2, and Senior Research Officer, requiring a degree from a university approved by the Board, demonstrated ability for research work, and in some cases, the capacity to supervise and direct other research officers. The regulations also affect the remuneration and advancement conditions for Research Officers, Assistants, detailing the minimum salary and the necessity for specific educational qualifications and demonstrated research aptitude. These amendments apply nationally across the Commonwealth of Australia, impacting the public service sector broadly, and are subject to the approval of the Governor-General.

Key Provisions

The Regulations under the Commonwealth Public Service Act 1922-1947, specifically amending the Commonwealth Public Service Regulations, introduce new conditions for officers seeking to be transferred or promoted to certain research positions. According to Regulation 112a (8), an officer cannot be transferred or promoted to the position of Research Officer, Grade 1 (earning between £414-£522) unless they have completed a degree from a university approved by the Board, and have the ability to undertake independent research or research work of similar responsibility, as deemed by the Board and the Permanent Head. For promotion to Research Officer, Grade 2 (earning between £522-£594), additional qualifications are required, including the ability to establish research lines and supervise other Research Officers, Grade 1, as per Regulation 112a (9). The highest level, Senior Research Officer (earning between £558-£672), demands completion of a suitable degree and evidence of capability to supervise a group of research officers or conduct important policy research, as stipulated in Regulation 112a (10). These regulations impose certain obligations on officers seeking to be transferred or promoted. They must complete a degree from an approved university and demonstrate specific research abilities and qualifications, which are assessed by the Board and the Permanent Head. The Board holds the authority to decide on the suitability of the officer's qualifications and abilities based on reports and their discretion. Furthermore, the Second Schedule introduces conditions for the position of Research Officer, Assistant (earning between £300-£414), where officers must demonstrate special aptitude and ability for research work, and the Board must be satisfied with their performance, as per the Second Schedule (1) and (2). Breaches of these conditions and requirements may result in officers not being eligible for transfer or promotion to the specified research positions. While the Regulations do not explicitly state penalties for non-compliance, failure to meet the specified qualifications and abilities could result in officers being denied advancement within the research hierarchy. The implications of such non-compliance would be the inability to secure higher positions, potentially impacting career progression and remuneration within the Commonwealth Public Service.
