Overview

The Commonwealth Public Service Regulations 1940 were introduced to amend the existing Commonwealth Public Service Regulations under the authority of the Commonwealth Public Service Act 1922-1939. Enacted by the Public Service Board and subsequently approved by the Governor-General, these regulations specifically address the restructuring of departments within the public service framework. The policy objective behind these amendments was to streamline and modernise the administrative divisions within the Commonwealth public service, reflecting changes in governmental priorities and the evolving nature of public administration during the period. The changes included the removal of the Department of Industry and the addition of the Department of Labour and National Service, along with the designation of the Secretary of the Department of Labour and National Service as a Chief Officer.

Scope and Application

The Statutory Rules 1940, No. 247, under the Commonwealth Public Service Act 1922-1939, serves to amend the Commonwealth Public Service Regulations, altering the composition of the Departments listed and their associated Chief Officers. The Regulations specifically remove the Department of Industry from the list of Departments and include the Department of Labour and National Service, adjusting the roles and responsibilities within the public service framework. This amendment is effective across the Commonwealth, applying to the entire public service, and involves changes to the administrative structure of government departments. The Regulations were approved by the Governor-General and are applicable nationwide, impacting the administrative hierarchy and the roles of Permanent Heads within the specified departments. These changes are made pursuant to the authority conferred by the Commonwealth Public Service Act, with no explicit exclusions or exemptions noted within the legislative instrument.

Key Provisions

The primary operative sections of the Statutory Rules 1940, No. 247 (the Regulations) involve amendments to the Commonwealth Public Service Regulations. Specifically, Regulation 1 omits the Department of Industry from the list of departments and adds the Department of Labour and National Service, while Regulation 2 includes the Secretary of the Department of Labour and National Service as a permanent head of a department (Regulation 1(a), (b); Regulation 2). These amendments are significant in that they redefine the scope of the departments overseen by the Public Service Board and the roles of the permanent heads within these departments. These Regulations impose obligations on the Public Service Board to ensure that the changes are implemented accurately and efficiently. The Board must ensure that the new list of departments and the inclusion of the Secretary of the Department of Labour and National Service are reflected in all relevant documentation and operational processes (Regulation 1(a), (b); Regulation 2). Furthermore, the Board must notify all relevant parties within the public service of these amendments to maintain transparency and compliance. The Regulations do not explicitly outline specific offences, penalties, or consequences for non-compliance. However, given the nature of statutory regulations, failure to comply with these amendments could result in administrative or legal consequences. These might include disciplinary actions against individuals or entities that do not adhere to the new departmental structure or roles outlined in the Regulations. The exact nature and severity of these consequences would depend on the specific circumstances and any additional legislative provisions governing the public service.
