Overview

The Statutory Rules 1926, No. 212, as amended by Statutory Rules 1930, No. 57, represent amendments to the Commonwealth Public Service Regulations under the Commonwealth Public Service Act 1922-1928. Enacted by the Board of Commissioners in pursuance of the authority conferred by the Act, these regulations aim to streamline and update the roles and responsibilities within the public service, including adjustments to salaries, the creation of new positions, and the removal of obsolete roles to better align with the evolving needs of the Commonwealth public service. These amendments were made subject to the approval of the Governor-General, reflecting the legislative process and oversight necessary to implement changes to public service regulations. The policy objective is to ensure that the public service remains efficient, responsive, and capable of meeting the demands of the nation.

Scope and Application

The Statutory Rules of 1930, No. 57, under the Commonwealth Public Service Act 1922-1928, outline amendments to the Commonwealth Public Service Regulations made by the Board of Commissioners. These amendments apply to various offices within the Commonwealth public service, specifically affecting salaries, increments, and the creation or abolition of certain positions. The changes are designed to realign roles, adjust remuneration scales, and streamline the public service structure. This legislation applies to personnel employed across different roles within the Commonwealth public service, impacting a broad range of positions from administrative to technical and artisan roles. The amendments are applicable nationwide, given the overarching jurisdiction of the Commonwealth government. Certain roles and their associated details have been either modified or eliminated, with new positions introduced to reflect evolving service needs. While the primary scope of these amendments is to update the existing regulatory framework, specific exclusions or exemptions are not explicitly stated within the text, implying that the changes are intended to be comprehensive across the affected areas.

Key Provisions

The main operative sections of these regulations include amendments to the Commonwealth Public Service Regulations (Statutory Rules 1926, No. 212, as amended). For instance, Regulation 105a has been amended by substituting the term "Home and Territories" with "Home Affairs" in paragraph (r) (1). Additionally, Regulation 106 has been amended in several ways, including adding new positions such as "Assistant (Despatch)" and "Assistant (Sales)" and altering salary details for existing positions (1). These amendments detail specific salary increments, minimum and maximum salaries, and annual increments for various roles within the Commonwealth Public Service. The obligations imposed by these regulations primarily concern the financial and structural management of the Commonwealth Public Service. These include detailed salary schedules and increments for various positions, which must be adhered to by the Public Service Board and relevant departments. Furthermore, these regulations require that certain positions, such as "Assistant (Despatch)" and "Assistant (Sales)," be filled with qualified personnel according to the specified salary and increment structures. The regulations also impose conditions on promotions and advancements within certain roles, such as requiring officers to pass specific tests in telegraphy and postal work to advance beyond certain salary levels. Breaches of these regulations may lead to various consequences, though the specific penalties are not detailed within the provided text. Generally, failure to comply with the salary and employment conditions set forth in these regulations could result in disciplinary action against the relevant officers or departments within the Commonwealth Public Service. While the exact penalties are not specified, such breaches could potentially lead to financial penalties, reassignment, or other administrative actions as deemed appropriate by the Public Service Board. The regulations also imply that non-compliance with the specified salary schedules and conditions could be considered grounds for legal or administrative redress.
