Overview

The Commonwealth Public Service Regulations 1950 were enacted to amend existing regulations under the Commonwealth Public Service Act 1922–1948. This legislative instrument was developed by the Public Service Board and approved by the Governor-General, with the aim of updating and refining various aspects of the public service regulations. The regulations address specific areas such as leave entitlements, salary calculations, allowances, and qualification requirements for certain offices within the public service. The objective of these amendments is to ensure that the public service regulations remain relevant and effective in meeting the needs of the Commonwealth public service. The regulations reflect the policy objective of maintaining a well-structured, efficient, and qualified public service workforce, thereby contributing to the overall governance and administration of the nation.

Scope and Application

The Commonwealth Public Service Regulations, amended by Statutory Rules 1950, No. 100, govern the administration and operation of the Commonwealth Public Service, providing detailed rules on various aspects such as leave entitlements, allowances, and salary structures. These regulations apply to officers and employees within the Commonwealth Public Service, including specific roles such as telegraphists, postal officers, and forestry officers, and extend to recognised state public services as specified. The amendments cover a range of provisions, such as adjustments to allowances for certain roles, the calculation of holiday pay, and qualifications required for promotion or transfer to specific positions. The regulations are designed to ensure consistent application of public service policies across the Commonwealth, while also accommodating specific needs or standards relevant to certain professional roles. Certain allowances and qualifications are subject to Board approval, and specific salary structures are outlined for various officer grades and positions. The regulations are subject to modifications through subordinate instruments, ensuring they can adapt to changing public service needs and standards.

Key Provisions

The key provisions of the Commonwealth Public Service Regulations, as amended by these Regulations, require the insertion and omission of certain terms in various sections to update the conditions of employment and allowances for public service officers. For example, Regulation 50 is amended to allow leave for examinations to be granted to officers or employees studying at a Technical College or School recognized by the Board, in addition to universities (Regulation 1(3)). Similarly, Regulation 62 is amended by removing the previous restriction on salary for furlough purposes (Regulation 2). Furthermore, a new regulation, 74D, is inserted to expand the definition of 'State Public Service' to include certain authorities from New South Wales, Victoria, and Western Australia (Regulation 4). The allowances for bicycles, cleaning and lighting, district allowances, and additional salary for certain positions are also updated or repealed and reinserted with new terms and conditions (Regulations 5 to 10). These Regulations impose several obligations on the Public Service Board, Chief Officers, and public service officers themselves. The Board must determine the appropriate qualifications and conditions of employment for certain positions, such as Forester, Research Officer, and Buildings Officer, based on the diplomas, degrees, or other qualifications that officers hold (Regulation 11). Chief Officers are required to authorize allowances for bicycle use and determine the eligibility of officers for these allowances (Regulation 5). Public service officers must meet the specified qualifications and conditions of employment to be considered for transfer or promotion to certain positions (Regulation 11). Additionally, officers must provide evidence of their capability and efficiency to be considered for salary advancement (Second Schedule). The Regulations do not explicitly outline specific offences, penalties, or consequences for breaches of the Act or the Regulations. However, it is likely that any breaches of these Regulations could result in disciplinary action, such as warnings, fines, or even termination of employment, depending on the severity of the breach and the specific provisions that have been violated. The maximum penalties for such breaches would be determined by the relevant authorities, such as the Public Service Board or the relevant government department.
