Except where otherwise provided advancement from grade to grade beyond Grade V. shall be dependent upon the occurrence of vacancies in the higher grades, or upon alteration of the classification of an office, the duties of which have materially changed.

Notwithstanding anything contained in this Regulation, in any case where an increment to an officer would be deferred, owing to the provisions of the Regulation, beyond the date upon which it would have otherwise accrued, the Commissioner may grant the increment from such date.

The grade of an officer under the provisions of this Regulation shall be that corresponding to his designation, provided that any officer who is receiving at the date of this Regulation a salary less than the minimum amount of such grade, may be granted annual additions of salary of an amount to be determined by the Commissioner until the salary reaches such minimum.

Notwithstanding anything in the schedule contained in this Regulation in any case where the Governor-General, on the recommendation of the Commissioner, directs that an office shall be classified in any particular grade, the officer occupying such office may, subject to the approval of the Commissioner, be advanced to the minimum salary of such grade.

Overview

The Statutory Rules of 1911, No. 95, under the Commonwealth Public Service Act 1902, was enacted to establish a structured grading system within the General Division of the Commonwealth Public Service. The Act was introduced to address the need for a systematic approach to the classification and remuneration of public servants, ensuring a fair and organised progression within their respective grades. This regulation, made by the Governor-General in accordance with the advice of the Federal Executive Council, outlines specific salary increments and the conditions under which public servants may be advanced to higher grades. The overarching policy objective is to maintain a structured and merit-based system that rewards efficiency and service, thereby improving the overall administration and functionality of the public service.

Scope and Application

The regulation issued under the Commonwealth Public Service Act 1902 establishes a structured grading system for officers in the General Division of the Commonwealth Public Service, setting forth the minimum, maximum, and increment salaries for various positions across different grades. It applies to officers in the General Division of the Commonwealth Public Service, encompassing a wide range of positions from Telegraph Messengers to Engineers, each designated with specific salary limits and conditions for advancement. The regulation specifies the conditions under which officers may be advanced to higher grades, such as after a certain period of service, upon passing a test, or reaching a certain age. Additionally, the regulation allows for the creation of new positions and the adjustment of existing positions' grades by the Governor-General upon recommendation from the Commissioner. It also provides mechanisms for officers to receive salary adjustments if they are below the minimum salary for their designated grade. This regulation has a national reach as it is a Commonwealth instrument, thereby applying across all jurisdictions within Australia. There are no stated exclusions or exemptions in the regulation, but it is noted that advancements beyond certain grades may be contingent on the occurrence of vacancies or changes in the classification of duties. The regulation further extends its application through subordinate instruments, allowing for flexibility in adjusting the classification of offices and the conditions for officer advancement.

Key Provisions

The primary sections of this regulation establish the structure and grading system for the General Division of the Commonwealth Public Service, with specific provisions for salaries, increments, and advancement criteria for various positions (Regulation 104). The schedule attached to this regulation details the specific grades, minimum and maximum salaries, and annual increments for each office within the General Division. It also outlines the conditions under which officers may be advanced to higher grades, typically based on years of service and performance evaluations. For instance, certain positions such as Telegraph Messengers and Junior Mechanics may be advanced to higher grades after a specified period of service and passing relevant tests. The regulation imposes several obligations on the parties it governs. It mandates that the limits of salary for officers occupying designated offices be as prescribed in the schedule unless otherwise directed by the Governor-General. Additionally, it requires the Commissioner to recommend to the Governor-General the creation of any new offices or the reclassification of existing offices, as well as the appropriate grade for such positions. The regulation also requires that officers receiving a salary below the minimum for their designated grade be granted annual salary additions until they reach the minimum salary threshold. Failure to comply with the provisions of this regulation may result in various consequences. While the regulation does not explicitly list offences or penalties, breaches of these salary and grading provisions could potentially be considered administrative violations. Such violations could lead to disciplinary actions against the officers involved, including demotion or termination of employment. Furthermore, officers who are not advanced to higher grades as per the stipulated conditions may have grounds to challenge their non-advancement, potentially leading to administrative reviews or legal recourse. It is important for both officers and the administration to adhere strictly to the terms of the regulation to avoid any adverse outcomes.
