Overview

Statutory Rules 1929 No. 91, Regulations Under the Commonwealth Public Service Act 1922-1928, was enacted to make amendments to the existing regulations governing the Commonwealth Public Service. This legislative instrument was made by the Board of Commissioners, in accordance with the authority conferred by the Commonwealth Public Service Act 1922-1928. The regulations aim to bring about adjustments in salary scales, training requirements, and other conditions of service for various public service positions within different departments. These amendments were approved by the Governor-General and came into operation immediately.

Scope and Application

The Statutory Rules 1929, No. 91, comprises amendments to the Commonwealth Public Service Regulations under the Commonwealth Public Service Act 1922-1928. These amendments apply to various positions within the Commonwealth Public Service, impacting officers in departments such as Trade and Customs, Home Affairs, and other specified departments. They introduce new training and qualification requirements for certain roles, specify salary increments, and modify existing allowances and conditions of service. The amendments are applicable across the Commonwealth of Australia and are subject to the approval of the Governor-General. Notably, the regulations address specific changes to officer roles, including salary scales, training requirements, and allowances for certain positions, reflecting adjustments to the public service structure and operational needs. The amendments extend the application of the Act through subordinate instruments, ensuring that the regulations are implemented effectively throughout the Commonwealth public service.

Key Provisions

The Statutory Rules 1929, No. 91, amends the Commonwealth Public Service Regulations under the Commonwealth Public Service Act 1922-1928. Among the key changes, Regulation 105a is significantly revised, particularly for officers in the Department of Trade and Customs. Specifically, a Junior Analyst who reaches 21 years of age and meets certain training and educational requirements will be designated as an Analyst with a minimum annual salary of £294. Additionally, officers who have graduated in law may receive a salary beyond £456 if the Board deems their work's character and importance warrant it, and if obtaining further qualifications for admission as a Barrister or Solicitor is not reasonably practicable due to location. These amendments impose specific obligations on the officers concerned, requiring them to complete designated training periods and courses, and to meet other conditions set forth in the regulation. Furthermore, the Board must be satisfied with the officers' performance and qualifications before any salary adjustments are made. Other amendments include changes to salary scales and conditions for various positions, such as the introduction of a Clerk position in the Inspection Branch in New South Wales, and adjustments to salary increments and maximum salaries for different roles. The regulations also introduce potential consequences for non-compliance. While the specific offences, penalties, or consequences for breaches are not detailed in the provided text, it is common in legislative instruments for non-compliance to lead to disciplinary actions, financial penalties, or other legal consequences. These could include fines, salary deductions, or even termination of employment, depending on the nature and severity of the breach. The precise penalties would typically be outlined in the relevant sections of the primary Act or in other regulations not provided here.
