Overview

The Statutory Rules of 1908, No. 108, made under the Commonwealth Public Service Act 1902, address the need for updated salary and grading structures within the Commonwealth Public Service. Enacted by the Governor-General, acting on advice from the Federal Executive Council, these regulations replace previous regulations and introduce a new structure for the General Division of the public service. This update aims to provide a clear and organised framework for salary increments and grade advancements based on service and performance, ensuring a fair and systematic approach to remuneration and career progression within the public sector. The policy objective is to maintain an efficient and motivated public service by establishing transparent criteria for salary adjustments and career advancement.

Scope and Application

The Regulations under the Commonwealth Public Service Act 1902, established by Statutory Rules 1908, No. 108, apply to officers within the Commonwealth public service, specifically those in the General Division. The Regulations detail a structured grading system for these officers, establishing minimum, maximum, and incremental salary brackets for various positions. The application of these salary structures is determined by the grade designation of the officer’s position, with provisions for annual salary increments contingent on service duration and demonstrated efficiency. Additionally, the Regulations detail specific provisions for officers who have completed significant periods of service, granting them long service increments. Advancement through the grades is contingent upon the availability of vacancies and changes in office classification. The Regulations also cover superannuation policies for public service officers, stipulating the amount of assurance and interest payable under specific conditions. The geographic scope of these Regulations is national, applying across the Commonwealth of Australia, with no stated exclusions or exemptions within the provided text. The Regulations themselves do not extend or restrict application through subordinate instruments.

Key Provisions

The Regulations under the Commonwealth Public Service Act 1902 (C1908L00108) primarily establish salary grades for officers within the General Division of the public service, as detailed in the Schedule attached to Regulation 104 (Schedule). The Schedule outlines various grades, from I to XII, each with a specified minimum and maximum salary range, as well as annual increments. The grades encompass a wide range of positions, from Messengers and Telegraph Attendants to more senior roles such as Line Inspectors and Mechanists. The Governor-General, upon the Commissioner’s recommendation, has the authority to create new positions and determine their grade. Additionally, officers who have completed 20 years of service may receive a long service increment after five years at the maximum of Grade IV, and another increment after an additional five years, provided they meet the efficiency and good conduct criteria. These Regulations impose specific obligations on both the public service officers and the Commissioner. Officers are required to meet certain service and age criteria to qualify for minimum salary payments, as outlined in Regulation 104. Furthermore, advancement through the salary grades is contingent upon the availability of vacancies in higher grades or changes in the classification of an officer’s duties. The Commissioner is responsible for determining the grade of an officer, ensuring that any officer receiving a salary below the minimum for their designated grade is granted annual salary additions until they meet the minimum threshold. The Commissioner also has the authority to permit officers to take out life assurance policies that provide for payments upon reaching the age of 60 or in the event of death before that age, as stipulated in Regulations 172 and 182. Failure to comply with the provisions of these Regulations may result in legal consequences. However, the specific offences, penalties, or consequences for breach are not detailed within the provided text. The Regulations establish a structured framework for salary grades and life assurance policies within the public service, aiming to ensure fair and systematic progression and financial security for officers.
