Overview

The Statutory Rules of 1916, Number 83, are provisional regulations enacted under the Commonwealth Public Service Act 1902–1915 to address immediate administrative needs within the public service of the Commonwealth. This legislative instrument was introduced due to an urgent requirement to adjust allowances for certain staff within the travelling post office system. The regulation was signed by Sir Arthur Stanley, acting as the Deputy of the Governor-General, with the advice of the Federal Executive Council, and was made effective from 1 January 1916. The specific amendment to the Commonwealth Public Service Regulations, as detailed in Statutory Rules 1913, Number 341, concerns the replacement of the existing allowance rate for Sorters and Assistants on travelling post office staffs with a new rate of 3 pence per hour. This change underscores the policy objective of ensuring fair and updated compensation for public service employees within the postal sector.

Scope and Application

The Provisional Regulation under the Commonwealth Public Service Act 1902-1915 applies to the employees specifically identified as Sorters and Assistants within the travelling post office staffs. This regulation directly impacts the financial allowances allocated to these personnel, setting their rate of allowance at 3d. per hour, thereby modifying the existing provisions previously detailed in Statutory Rules 1913, No. 341. The regulation is part of a broader legislative framework designed to govern the Commonwealth Public Service, thus its application extends across the Commonwealth of Australia, ensuring uniformity and consistency in public service standards and employee entitlements throughout the nation. The regulation does not specify any exclusions or exemptions, nor does it establish thresholds that might limit its application; rather, it serves as an amendment to existing regulations, thereby extending its effect to all relevant personnel across the Commonwealth. Additionally, the regulation may be subject to further modifications or expansions through subordinate instruments, allowing for adjustments as necessary to meet evolving public service needs.

Key Provisions

The main operative sections of the Provisional Regulation under the Commonwealth Public Service Act 1902–1915, as outlined in Statutory Rules 1916, No. 83, involve a specific amendment to the Commonwealth Public Service Regulations. Regulation 140(c) has been repealed and replaced with a new provision concerning the allowance rate for Sorters and Assistants on the staffs of travelling post offices. Specifically, sub-regulation (c) now mandates that the rate of allowance to Sorters and Assistants shall be 3d. per hour (Section 2). This adjustment affects the remuneration for these roles within the public service, providing a clear and updated allowance for their work in travelling post offices. The obligations and requirements imposed by this Regulation are primarily directed at the travelling post office staffs and the administrative bodies overseeing the public service. The amendment necessitates that Sorters and Assistants on travelling post offices receive an allowance of 3d. per hour. This update ensures that compensation for these roles is consistent and accurately reflects the current standards set forth by the legislation. The Regulation requires the relevant authorities to implement and adhere to this new allowance rate in their payroll and administrative practices. The Provisional Regulation does not explicitly outline offences, penalties, or civil/criminal consequences for breach within its text. However, any failure to comply with the updated allowance rate could potentially lead to disputes or claims from the affected employees regarding non-payment or underpayment. While the specific penalties for such breaches are not detailed in the Regulation itself, they would typically be governed by the broader provisions of the Commonwealth Public Service Act 1902–1915 and any related industrial or employment laws. The consequences could range from financial restitution to the employees to administrative or legal actions taken by the public service authorities to rectify the non-compliance.
