REGULATION UNDER THE COMMONWEALTH PUBLIC SERVICE ACT 1902–1916.

I, SIR JOHN MADDEN, acting as the Deputy of the Governor-General, in accordance with the provisions of the constitution, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Commonwealth Public Service Act 1902–1916 to come into operation forthwith.

Amendment of Commonwealth Public Service Regulations.

The Public Service Regulations are amended by the insertion after Regulation 173 (3) of the following sub-Regulation:—

(4). In any case where an officer between 1st July, 1915, and 18th April, 1916, increased the amount of his assurance in accordance with the table prescribed in Regulation 172 in consequence of the maximum salary of his position having been raised by Award of the Commonwealth Court of Conciliation and Arbitration or by amendment of Public Service Regulation 104, such officer may be allowed to reduce the amount of his assurance to the amount for which he would have been required to assure had the maximum salary of his position not been increased by Award of the Arbitration Court or amendment of Regulation 104.

Application for reduction of amount of assurance under the provisions of this sub-Regulation must be made to the Chief Officer within three months of the date of this Regulation, otherwise reduction shall not be allowed: Provided that in the case of officers who are members of the Expeditionary Forces application may be made before the expiration of three months of the date of resumption of duty in the Commonwealth Public Service.

Overview

The Statutory Rules 1917 No. 8, enacted under the Commonwealth Public Service Act 1902–1916, addresses a specific issue arising from salary adjustments and assurance amounts within the Commonwealth Public Service during and shortly after World War I. This legislative instrument was created to provide flexibility in assurance amounts for public servants whose salaries had been increased due to awards or amendments, but who now sought to revert to previous assurance levels. The regulation was issued by Sir John Madden, acting as the Deputy of the Governor-General, following the advice of the Federal Executive Council, and it came into immediate effect. The policy objective outlined in the regulation is to allow public servants who had their salaries increased between 1 July 1915 and 18 April 1916 to apply for a reduction in their assurance amounts to the levels they would have been required to assure had their salaries not been increased. This provision was intended to accommodate the unique circumstances of public servants who had temporarily increased salaries and subsequently sought to revert to their original assurance amounts.

Scope and Application

This statutory rule, made under the Commonwealth Public Service Act 1902–1916, concerns the amendment of the Public Service Regulations. Specifically, the regulation addresses the circumstances under which a public service officer who increased their assurance amount between 1st July, 1915, and 18th April, 1916, due to a rise in their position's maximum salary may seek a reduction of their assurance amount. This applies to officers whose salary was increased by the Commonwealth Court of Conciliation and Arbitration or through an amendment to Public Service Regulation 104. The regulation stipulates that an application for the reduction must be made to the Chief Officer within three months of the regulation's enactment, with an extension granted for officers who are members of the Expeditionary Forces until three months after they resume duty in the Commonwealth Public Service. The amendment is intended to provide flexibility and relief to officers affected by the salary increases during a period of significant change.

Key Provisions

The Commonwealth Public Service Regulations are being amended by the introduction of a new sub-Regulation, specifically Regulation 173 (4). This new provision allows officers who increased their assurance amounts between 1 July 1915 and 18 April 1916 due to salary increases, to potentially reduce their assurance amounts. This reduction would be to the amount they would have been required to assure if their salary had not been increased by an Award of the Commonwealth Court of Conciliation and Arbitration or an amendment of Regulation 104. This change is a response to the unique circumstances of salary adjustments during this period, aiming to provide some flexibility to officers who may now find their assurance amounts too high. For officers who wish to avail themselves of this opportunity, there are specific obligations they must meet. They must make an application to the Chief Officer within three months from the date of this Regulation, which is 17 January 1917. The application must detail the increase in assurance and the reason for the request to reduce it. For officers who are part of the Expeditionary Forces, the application can be made before the expiration of three months from the date they resume duty in the Commonwealth Public Service. This provides a window for those in service to also adjust their financial commitments without undue delay. Failure to adhere to the timelines and procedures outlined in the new Regulation may result in the forfeiture of the opportunity to reduce the assurance amount. There are no explicit criminal penalties or fines mentioned in this Regulation; however, the strict timelines indicate that the non-compliance could have significant administrative consequences, such as not being allowed to reduce the assurance amount as intended. The inclusion of this sub-Regulation aims to offer some relief to officers who may be financially strained due to the increases in their financial commitments without a corresponding increase in their salaries. By providing a pathway to reduce their assurance amounts, the Regulation seeks to balance the financial stability of officers with the need to adjust to changes in salary structures during a period of significant national upheaval.
