Overview
The Statutory Rules 1911 No. 56, Provisional Regulations under the Defence Act 1903-1910, were introduced to address the urgent need for regulations concerning the Commonwealth Military Cadet Corps. Enacted by the Governor-General in Council, these regulations were intended to provide immediate operational guidance and flexibility in the management of cadet units within schools. The policy objective behind these provisional regulations was to ensure that the necessary infrastructure, such as miniature rifle ranges, could be constructed or expanded efficiently, subject to the availability of funds and approval from the District Commandant. This legislative instrument was designed to swiftly bridge gaps in existing regulations to support the operational needs of cadet units during the period 1910-1911.
Scope and Application
The Provisional Regulations under the Defence Act 1903-1910, particularly the new Regulation 44 (a), pertain to the construction or enlargement of miniature rifle ranges in schools that host Cadet, Mounted Cadet, or Senior Cadet units or detachments during the year 1910-1911. This regulation applies directly to educational institutions that house these cadet units or detachments and seeks to ensure that any proposed construction or enlargement of rifle ranges is approved by the District Commandant. The regulation also mandates that the funds for such projects must be sourced from the credit balance of allowances paid to the schools as "Detachment" or "Clothing" allowances. The approval process extends to the design and cost of the work, ensuring that the expenditure aligns with the military cadet program's objectives and resource constraints. The scope of this regulation is geographically limited to the Commonwealth of Australia, reflecting its national application under the authority of the Defence Act. There are no stated exclusions or exemptions within this provisional regulation, though the requirement for District Commandant approval introduces a layer of oversight to the implementation process.
Key Provisions
The primary operative sections of the Provisional Regulations under the Defence Act 1903-1910 pertain to the construction or enlargement of miniature rifle ranges in schools that have Cadet, Mounted Cadet, or Senior Cadet units or detachments. Section 3, through the addition of new Regulation 44(a), allows for the construction or enlargement of these ranges during the year 1910-1911, provided there is sufficient funding available from the credit balance of allowances paid to the schools as "Detachment" or "Clothing" allowances. This expenditure must receive the approval of the District Commandant in terms of both the design and the cost of the work.
The Regulations impose several obligations and requirements on the parties involved. Schools with Cadet, Mounted Cadet, or Senior Cadet units or detachments must ensure that any proposed construction or enlargement of miniature rifle ranges is subject to the approval of the District Commandant. This approval process is crucial and must be followed meticulously to ensure that the funding for such projects comes from the specified allowances and is not misappropriated from other sources. The District Commandant’s role extends to approving not only the expenditure but also the design of the ranges, ensuring they meet certain standards or specifications deemed necessary for safety and operational purposes.
In the event of a breach of these regulations, the consequences can be significant. While the specific statutory rules do not outline explicit offences or penalties, any misuse of the "Detachment" or "Clothing" allowances for purposes other than those permitted by the Regulations could lead to administrative and potentially legal repercussions. This could include investigations by the relevant military or defence authorities, which might result in financial penalties or other disciplinary actions against the responsible parties. The gravity of such breaches would likely depend on the extent of the misuse and the discretion of the authorities involved in enforcing the regulations.
