Overview

Statutory Rules 1907 No. 87, titled "Provisional Regulations Under the Defence Acts 1903-1904", was enacted to address the immediate need for regulations governing the Commonwealth Military Cadet Corps. The regulations were introduced to provide clear guidelines for allowances and payments to cadets, ensuring that new detachments could be promptly supported. The enacting body for these regulations was the Governor-General in Council, who acted with urgency in recognising the necessity of these provisional regulations coming into immediate operation. The policy objective was to facilitate the effective functioning of the Military Cadet Corps by establishing a prompt and structured method for financial support to cadets, thereby ensuring continuity and preparedness within the defence framework.

Scope and Application

The Provisional Regulations under the Defence Acts 1903-1904 pertain to the Commonwealth Military Cadet Corps and encompass provisions concerning allowances and payments to cadets and senior cadets. These regulations are applicable to both cadets and senior cadets within the Commonwealth Military Cadet Corps, providing specific allowances and conditions for their remuneration, subject to the approval of the District Commandant. The regulations are issued under the authority of the Governor-General and are intended to come into immediate operation, reflecting an urgency recognised by the Federal Executive Council. The amendments specified within these regulations affect the payment timelines for allowances, extending the date from 30th June to 31st December and ensuring that allowances for new detachments are paid as soon as possible after official announcement. The scope of these regulations is national, applying across the Commonwealth as a whole.

Key Provisions

The primary operative sections of these Provisional Regulations under the Defence Acts 1903-1904 pertain to amendments within the Commonwealth Military Cadet Corps. Section 1, paragraph 5 (a), modifies the date from "30th June" to "31st December" in two instances (Section 1, para. 5 (a)). Additionally, new provisions are added at the end of paragraphs 4, 19, and 21 in Section 2, stipulating that for new detachments, allowances will be paid as soon as possible after official publication, subject to the approval of the District Commandant (Section 1, para. 4; Section 2, para. 19; Section 2, para. 21). These Regulations impose specific obligations on the parties involved. They require that the allowances for Senior Cadets and Cadets in new detachments be processed and paid promptly, pending approval from the District Commandant. This approval process ensures that financial disbursements align with the established protocols and authorisations, thereby maintaining fiscal discipline and adherence to the stipulated terms of allowance. In terms of consequences for non-compliance, the Regulations do not explicitly outline offences or penalties within the text provided. However, it is reasonable to infer that any failure to adhere to the stipulated processes could potentially result in administrative repercussions. These might include delays in allowance payments or other disciplinary actions deemed necessary by the relevant authorities to ensure compliance with the Regulations. The absence of specified penalties in the provided excerpt implies that further examination of the overarching Defence Acts 1903-1904 might be required to determine the exact civil or criminal consequences of non-compliance.
