Overview

The Commonwealth Grants Commission – Part-time Members – Reappointments (No. 1) 2021 Instrument, enacted in 2021, was established to address the need for continued expert oversight and evaluation of financial allocations between the Commonwealth and the states in Australia. This legislative instrument reappointed Jeffrey Petchey and Lynne Williams AM as part-time members of the Commonwealth Grants Commission, thereby ensuring ongoing stability and expertise in the commission's operations. The reappointments were made under the authority granted by subsection 8(2) of the Commonwealth Grants Commission Act 1973, reflecting the policy objective of maintaining effective and informed decision-making processes regarding financial distributions. This not only upholds the integrity of the grant allocation system but also ensures that the commission's recommendations are based on current and relevant expertise.

Scope and Application

The F2021N00213 (Notifiable instrument) Commonwealth Grants Commission – Part-time Members – Reappointments (No. 1) 2021I pertains to the reappointment of specific individuals to the Commonwealth Grants Commission on a part-time basis. This instrument applies directly to Jeffrey Petchey and Lynne Williams AM, reappointing them for specified terms. The act is issued under the authority of the Commonwealth Grants Commission Act 1973, with the Governor-General acting on the advice of the Federal Executive Council. The geographic reach of this legislation is nationwide, as it concerns a federal body. The reappointments are effective from 1 September 2021, with Jeffrey Petchey's term lasting for two years and Lynne Williams AM's term lasting for five years. This notifiable instrument does not explicitly state exclusions, exemptions, or thresholds, but it does specify the terms and conditions under which these part-time members are reappointed. The application of this act may be further extended or restricted through subordinate instruments, but the primary focus remains on the reappointment of the specified individuals to their roles within the Commonwealth Grants Commission.

Key Provisions

The main operative sections of this legislation, F2021N00213, involve the reappointment of two part-time members to the Commonwealth Grants Commission. Section 3(a) reappoints Jeffrey Petchey for a period of two years, beginning 1 September 2021, while section 3(b) reappoints Lynne Williams AM for a period of five years starting from the same date. These sections serve to legally reinstate the individuals in their roles, ensuring continuity and stability in the commission’s operations. The Act imposes specific obligations on the reappointed members, Jeffrey Petchey and Lynne Williams AM. As part-time members of the Commonwealth Grants Commission, they are required to dedicate their expertise and time to the commission’s functions, which primarily involve assessing and advising on the distribution of Commonwealth grants to the states and territories. Their part-time nature means they must balance these duties with other professional or personal commitments, yet remain fully committed to the commission's objectives during their appointed terms. Failure to meet the obligations set out in their reappointment could lead to various consequences. While the legislation itself does not explicitly detail penalties for non-compliance, breaches of the conditions of their appointments could potentially result in legal actions under other applicable laws or internal commission policies. The seriousness of such actions would depend on the nature and extent of the breach, but could theoretically lead to their removal from office, depending on the specific terms of their reappointment and any relevant legal frameworks governing their conduct. The legislation does not outline specific offences or penalties within its text. However, any actions taken against the members for failing to meet their obligations would likely be guided by the broader legislative and administrative frameworks under which the Commonwealth Grants Commission operates. This might include disciplinary measures, financial penalties, or other legal repercussions, depending on the circumstances and the severity of the breach.
