COMMONWEALTH EMPLOYEES (REDEPLOYMENT AND RETIREMENT) REGULATIONS (AMENDMENT)

Sub-section 29(1) of the Commonwealth Employees (Redeployment and Retirement) Act 1979 (the Act) enables the Governor-General to make regulations prescribing all matters which are required or permitted to be prescribed.
Paragraph 22(5)(a) of the Act enables the regulations to provide a maximum retiring age for a class of employees, being an age less than 65 years.
The purpose of this regulation is to prescribe a maximum age of retirement of 60 years for Air Traffic Controllers and related supervisory positions. This change was foreshadowed in regulations made in December 1984 which prescribed a minimum retiring age of 50 years for the same class of employees. The changes reflect circumstances unique to the category and their working arrangements and were endorsed by the Government in July 1984.
