Overview

The Statutory Rules 1932, No. 96, made under the Commonwealth Bank Act 1911-1932, were introduced to amend the existing regulations to ensure they remain consistent and aligned with the evolving practices of the Commonwealth Bank of Australia. This legislative instrument was enacted by the Governor-General in Council, reflecting the authority of the Commonwealth Parliament to regulate the operations of the Commonwealth Bank. The primary objective of these amendments is to streamline the regulatory framework governing the bank's financial reporting and documentation processes, ensuring clarity and effectiveness in the bank's operations and financial disclosures.

Scope and Application

The Statutory Rules 1932, No. 96, made under the Commonwealth Bank Act 1911-1932, introduce amendments to the Commonwealth Bank Regulations, which apply to the Commonwealth Bank of Australia, a statutory body created under the Act. The scope of these regulations includes the governance and operational aspects of the Bank, specifically focusing on the reporting and disclosure requirements concerning the Bank's financial position and transactions. These regulations are applicable nationally, covering the entire Commonwealth of Australia. The stated exclusions or exemptions within these regulations pertain to the specific forms and details that have been omitted and replaced with new forms, as outlined in the amendments. The application of these regulations may be further extended or restricted through subordinate instruments, ensuring that the Bank adheres to the prescribed financial reporting standards and maintains transparency in its operations.

Key Provisions

The Statutory Rules 1932, No. 96, made under the Commonwealth Bank Act 1911-1932, introduce several amendments to the Commonwealth Bank Regulations. These amendments, which come into effect immediately, primarily revise certain forms and statements that the Commonwealth Bank must prepare and maintain. For example, Regulation 15 now requires the submission of a Statement of Liabilities and Assets that includes specific details about the bank's capital, coin, bullion, cash balances, and other assets (Regulation 15). Similarly, Regulation 16 mandates the preparation of a balance sheet that outlines the bank's liabilities, assets, and contingent liabilities (Regulation 16). Regulation 17 pertains to the balance sheet of the Note Issue Department, which must detail the notes in circulation and the bank's gold and English sterling holdings (Regulation 17). Finally, Regulation 29 concerns the Treasurer's statement of the combined accounts of the Commonwealth Bank of Australia and the Commonwealth Savings Bank, requiring comprehensive details of the bank's capital, liabilities, assets, and contingent liabilities (Regulation 29). These amendments impose specific reporting obligations on the Commonwealth Bank, requiring the preparation and submission of detailed financial statements that adhere to the newly prescribed formats. The bank must ensure that these statements include all relevant financial information, such as capital accounts, coin, bullion, cash balances, liabilities, assets, and contingent liabilities. By doing so, the bank must comply with the detailed requirements set out in the amended regulations, ensuring that all financial activities and positions are accurately reflected in the submitted documents. The legislation does not explicitly outline specific offences, penalties, or consequences for non-compliance with these amended regulations. However, it is implied that failure to adhere to the requirements could result in regulatory scrutiny, potential investigations, and possible sanctions under the Commonwealth Bank Act 1911-1932. While the exact penalties are not detailed in the text, non-compliance with banking regulations can often lead to financial penalties, enforcement actions, or other legal repercussions, depending on the severity and impact of the non-compliance.
