Overview

The Letters Patent issued on 28 March 1983, under the authority of Elizabeth the Second, Queen of Australia, and by advice of the Federal Executive Council, vary the previous Letters Patent issued on 25 June 1981. This alteration expands the scope of the inquiry led by Donald Gerard Stewart, who was appointed as Commissioner to investigate Terrence John Clark and entities associated with him. The expanded mandate addresses potential contraventions of Commonwealth laws by the Nugan Hand Group, including illegal activities such as drug and armament trafficking, and exchange control violations. It also investigates any interference with Commonwealth investigations and the involvement of associated persons, organisations, or bodies in illegal activities or bribery attempts to influence investigations. The policy objective of this variation is to ensure a comprehensive inquiry into the activities of the Nugan Hand Group and related entities, considering reports from relevant bodies and ensuring that the inquiry does not overlap with other ongoing investigations. The Commissioner is tasked with reporting the findings and recommendations by 31 December 1983. This legislative instrument aims to address the identified gaps and expand the scope of the initial inquiry to cover broader concerns related to the Nugan Hand Group’s activities.

Scope and Application

This legislation pertains to a Royal Commission, established to investigate and report on specific matters relating to Terrence John Clark and associated persons, particularly the Nugan Hand Group. The scope of the inquiry includes investigating whether the Nugan Hand Group engaged in activities involving the contravention of Commonwealth laws, particularly those related to drug and armament importation, exportation, and possession, as well as exchange control laws. It also examines whether these activities involved local government authorities in New South Wales, the extent and nature of these activities, and any associations with other persons, organizations, or bodies. Furthermore, the inquiry will determine if there were any attempts to bribe Commonwealth officers or improperly interfere with investigations by Australian law enforcement bodies. The inquiry extends to examining the activities of any person, organization, or body associated with the Nugan Hand Group, including specified corporations and others controlled by Frank John Nugan or Michael Hand. The Royal Commission is mandated to consider reports from relevant bodies such as the Commonwealth/State Joint Task Force on Drug Trafficking and the Corporate Affairs Commission of New South Wales. The legislation is applicable across Australia and involves multiple entities, including individuals, corporations, and law enforcement bodies. It also includes specific corporations listed in the schedule, which are subject to liquidation or investigation by liquidators appointed by the Supreme Court of New South Wales. The scope of the inquiry is not limited by existing investigations by the National Crimes Commission or another Commissioner appointed to inquire into certain matters relating to the Federated Ship Painters and Dockers Union.

Key Provisions

The primary sections of the legislation, specifically the Letters Patent issued on 28 March 1983, vary the initial Letters Patent issued on 25 June 1981, expanding the scope of the inquiry by the Commissioner. This includes investigating whether the Nugan Hand Group engaged in activities that contravened Commonwealth laws, particularly those related to drug and armament trafficking and exchange control (section 1(a)), whether the group engaged in activities that contravened laws of local government authorities in New South Wales (section 1(b)), and further details regarding these activities (sections 1(c) to 1(g)). The legislation also defines terms such as "Nugan Hand Group" and "Australian law enforcement body" (sections 1(h) and 1(j)). The obligations imposed by the Act on the Commissioner include conducting a comprehensive inquiry into the specified matters, considering relevant reports and investigations, and ensuring that the inquiry does not overlap with investigations by other bodies such as the National Crimes Commission or the Commissioner appointed to inquire into matters relating to the Federated Ship Painters and Dockers Union (section 1(f)). The Commissioner must submit a report to the Governor-General by 31 December 1983 detailing the findings and recommendations (section 1(m)). Breach of the obligations set forth in the legislation does not explicitly outline specific offences, penalties, or consequences within the text provided. However, the failure to comply with the directives of the Royal Commissions Act 1902, which governs the operation and powers of Royal Commissions, could potentially lead to legal repercussions. Under the Royal Commissions Act 1902, contempt of the Commission could result in penalties, including fines and imprisonment, as stipulated in section 16 of the Act. Furthermore, any actions taken by the Nugan Hand Group or associated entities that contravene Commonwealth laws could result in separate criminal or civil penalties as prescribed by the relevant statutes.
