Overview
The Commission to Administer the Government of the Commonwealth of Australia Act 2015 was enacted in response to the need for a clear and legally sound framework governing the administration of the Government in the absence of the Governor-General. This Act, which received the Royal Assent on 13 March 2015, was passed by the Parliament of Australia to address the gaps in the existing provisions for the temporary administration of the Commonwealth Government. The policy objective of this legislation is to ensure a seamless transition of power and continuity of government in the event of the Governor-General's absence, death, incapacity, or removal from office, thereby maintaining the stability and efficiency of the Commonwealth administration. The enacting body was the Australian Parliament, which sought to provide a definitive legal basis for the appointment of an administrator to uphold the functions of the Governor-General when necessary.
Scope and Application
The Commission to Administer the Government of the Commonwealth of Australia, enacted under the Royal Sign Manual and the Great Seal of Australia, designates His Excellency the Honourable Hieu Van Le as the Administrator of the Government in the event of the absence, death, incapacity, or removal of the Governor-General, or in the case of a temporary absence from office. This appointment applies solely within the territorial jurisdiction of Australia and operates under the overarching constitutional framework that governs the Commonwealth. The legislation underscores the continuity of government administration by specifying that the appointed Administrator will assume the role upon a formal request being made in accordance with the Letters Patent as amended, relating to the office of Governor-General. The application of this Commission is strictly confined to the prescribed contingencies affecting the Governor-General's ability to perform their duties and does not extend to routine governance unless explicitly necessitated by the outlined circumstances.
Key Provisions
The primary sections of this legislation (Commission to Administer the Government of the Commonwealth of Australia) outline the circumstances under which His Excellency the Honourable Hieu Van Le AO will assume the role of administering the government in the absence or incapacity of the Governor-General. Specifically, section 1 states that the Governor of South Australia, Hieu Van Le, is appointed to administer the government if the Governor-General is absent from Australia, incapacitated, removed from office, or temporarily absent. This is to ensure a seamless transition of power in the absence of the Governor-General. Section 2 further clarifies that this appointment remains in effect as long as it pleases the Queen.
The Act imposes certain obligations and requirements on His Excellency the Honourable Hieu Van Le AO. Firstly, he must be ready to assume his role at any moment, as stipulated in section 1, should the Governor-General be unavailable. This includes being prepared to administer the government during any temporary absence of the Governor-General. Additionally, the commission remains in force until the Queen decides otherwise, which means that His Excellency must be vigilant and prepared to act as needed.
Regarding consequences for non-compliance or breach of the provisions outlined in this legislation, it is not explicitly stated in the text provided. However, in general terms, failure to act in accordance with such a commission could lead to legal and constitutional issues. Such a breach might be subject to judicial review or other legal consequences, though the specific penalties are not detailed here. It is important to note that any actions taken under this commission must align with the overarching legal framework of the Australian Constitution and other applicable laws.
