Overview

The Co-operative Farmers and Graziers Direct Meat Supply Limited (Loan Guarantee) Act 1978 was enacted to address the need for financial stability within the meat supply co-operative sector by providing a guarantee for a specific borrowing. This legislation authorises the Finance Minister to give a guarantee on behalf of the Commonwealth for the repayment of half the principal amount of a loan taken by the Co-operative Farmers and Graziers Direct Meat Supply Limited, subject to certain conditions. The primary policy objective is to protect the financial interests of the Commonwealth while supporting the operations of the meat supply co-operative. The Act was passed by the Australian Parliament and came into effect on the day it received Royal Assent. The guarantee provided under the Act is capped at a maximum of $4,500,000 or half of the outstanding principal, whichever is less, and it stipulates that the borrowing must be for a period not exceeding three years and must meet other specified conditions, including the requirement for a similar guarantee from the State of Victoria.

Scope and Application

The Co‑operative Farmers and Graziers Direct Meat Supply Limited (Loan Guarantee) Act 1978 authorises the Finance Minister, on behalf of the Commonwealth, to provide a guarantee for one-half of the principal moneys in relation to a borrowing by Co‑operative Farmers and Graziers Direct Meat Supply Limited, subject to specific conditions. The Act applies to the Society, defined as Co‑operative Farmers and Graziers Direct Meat Supply Limited, and to the Finance Minister who administers the Financial Management and Accountability Act 1997. The Act permits the guarantee to be issued to cover up to a maximum of $4,500,000 or one-half of the principal moneys that have not been repaid by the Society, whichever is the lesser amount. The Act also stipulates that a guarantee will not be provided unless a like guarantee is given by the Treasurer of the State of Victoria, the borrowing period does not exceed three years, and certain other conditions are met, including access to the Society's financial accounts by persons appointed or engaged under the Public Service Act 1999. This Act applies to the Commonwealth jurisdiction, with its application potentially extended or restricted through subordinate instruments as necessary.

Key Provisions

The Co-operative Farmers and Graziers Direct Meat Supply Limited (Loan Guarantee) Act 1978 (sections 4 and 5) authorises the Finance Minister to provide a guarantee for one-half of the principal moneys in relation to a borrowing by Co-operative Farmers and Graziers Direct Meat Supply Limited (referred to as the "Society") for the purpose of repaying its debts. The guarantee cannot exceed $4,500,000 or one-half of the outstanding principal moneys, whichever is less. The guarantee can only be given if specific conditions are met, including a reciprocal guarantee by the Treasurer of the State of Victoria, borrowing for a period not exceeding three years, and provisions for public servants to have access to the Society's financial accounts. The Act imposes several obligations on the Finance Minister and the Society. The Finance Minister must ensure that certain conditions are fulfilled before issuing a guarantee, such as obtaining a like guarantee from the State of Victoria, ensuring reasonable terms for the borrowing, and ensuring that authorised public servants have access to the Society's financial accounts. The Society, on the other hand, must comply with the conditions set forth in the Act to be eligible for the guarantee. Breach of the conditions set forth in the Act may lead to civil or criminal consequences. However, the Act itself does not specify any particular offences, penalties, or consequences for breach. The Act primarily focuses on the conditions under which the guarantee can be provided and the obligations of the parties involved. Any legal ramifications of a breach would likely be determined by other relevant laws and regulations.
