Overview

The Regulations for Civilian Staff (Other Than Government Factories) Under Defence Act 1903-1927 was enacted in 1928 by the Governor-General in accordance with the Federal Executive Council. This statutory rule aimed to address discrepancies and provide clarity regarding the salaries and conditions of civilian staff within the Defence sector, ensuring that pay structures were equitable and up-to-date. The policy objective was to standardise civilian staff remuneration and provide a transparent mechanism for salary adjustments based on economic indicators such as the cost of living index. The regulations were designed to ensure fairness and consistency in the payment of salaries across various civilian roles within the Defence framework, thereby supporting operational efficiency and employee satisfaction.

Scope and Application

The Regulations for Civilian Staff (Other Than Government Factories) Under Defence Act 1903-1927, enacted by the Governor-General, governs civilian staff within the Defence sector, excluding those employed in government factories. These regulations apply to various civilian roles across different branches and states within the Commonwealth of Australia. The rules specify salary structures, increments, and conditions for a range of positions, including assistants, typists, messengers, and others. Adjustments to salary are determined by age and gender, with specific provisions for incremental increases based on changes in the cost of living index. The regulations also include provisions for employees who were previously earning higher salaries under prior regulations to continue receiving their existing pay until they vacate their positions or the duties change. Notably, the regulations allow for variations in salary based on economic conditions as reflected in the cost of living index for food, groceries, and housing. These amendments and new provisions are set to take effect on specified dates, as detailed within the regulations.

Key Provisions

The Regulations for Civilian Staff (Other than Government Factories) under the Defence Act 1903-1927, published as Statutory Rules 1928 No. 19, introduce significant amendments to the salary structures and office designations for various civilian staff roles within the Defence Department. These amendments are effective from various dates, primarily from 1st July 1926 and 1st April 1927, unless otherwise specified. The regulations detail new salary brackets and increments for roles such as Assistant, Lift Attendant, Messenger, Typist, and various specialist roles like Chart Corrector and Plan Printer, among others. Additionally, certain offices such as Assistant (Typing), Navy Secretariat and several Messenger and Telephonist roles have been deleted. These regulations impose specific salary structures on civilian staff, dictating minimum and maximum salaries based on age and role. For example, the salary for an Assistant (male) under 17 years of age is set at £84 per annum, increasing incrementally to £212 per annum for adults. Similarly, roles such as Lift Attendant and Watchman have their own defined salary ranges. Furthermore, the regulations specify conditions for increments and advancements, particularly for typists, who must demonstrate certain skills and efficiency standards to advance beyond £100 per annum. The regulations also include provisions for adjusting salaries based on the Commonwealth Statistician’s index numbers for food, groceries, and housing, which are to be notified in the Gazette. If the index number falls outside the range of 1,672 to 1,744, salaries for employees under 21 years, adult female employees, and adult male employees (with a maximum salary of £600 per annum) are to be adjusted by specific amounts per annum. These adjustments take effect from the 1st July following the notification of the index number and remain in force for twelve months. In terms of consequences for breach, the regulations do not explicitly outline criminal or civil penalties for non-compliance. However, adherence to the specified salary structures and office classifications is mandatory for all civilian staff governed by these regulations. Failure to comply with the stipulated salary adjustments based on the index number could potentially lead to disputes or claims for underpayment, although specific penalties are not detailed within the text of the regulations.
