Overview

The Civil Aviation (Unmanned Aircraft Levy) Regulations 2021 were enacted under the Civil Aviation (Unmanned Aircraft Levy) Act 2020 with the aim of regulating the levy for unmanned aircraft, also known as remote piloted aircraft (RPA). This legislation was introduced to address the growing concerns and need for regulation surrounding the use of unmanned aircraft in Australia, which includes ensuring safety, privacy, and security while promoting innovation and growth in this sector. The regulations are made by the Governor-General under the authority granted by the Act and define key terms such as "RPA" and "levy." The primary policy objective is to establish a structured financial contribution mechanism for unmanned aircraft operations, ensuring that operators contribute to the regulatory costs associated with overseeing their activities. These regulations prescribe the amount of levy to be paid for unmanned aircraft, distinguishing between those that weigh more than 500 grams and those that weigh 500 grams or less. For aircraft over 500 grams, a levy of $40 applies, whereas no levy is imposed on those weighing 500 grams or less. This distinction aims to balance the regulatory burden with the operational scale and potential impact of the unmanned aircraft. The regulations are designed to be straightforward and provide clear guidelines for operators to understand their financial obligations under the Act.

Scope and Application

The Civil Aviation (Unmanned Aircraft Levy) Regulations 2021, made under the Civil Aviation (Unmanned Aircraft Levy) Act 2020, apply to levy imposition on unmanned aircraft (RPAs) based on their weight. Specifically, the regulations define the amount of the levy: a fee of $40 applies to unmanned aircraft weighing more than 500 grams, while those weighing 500 grams or less are exempt from any levy. These regulations are applicable across Australia, as they fall under the Commonwealth's jurisdiction. The scope of these regulations does not explicitly exclude any particular entities or industries, thus they generally apply to all operators of unmanned aircraft within the country. The regulations can be modified through subordinate instruments, as evidenced by amendments such as the Civil Aviation Legislation Amendment (2023 Measures No. 1) Regulations 2023, which made adjustments to the levy amounts and other related provisions. Any uncommenced amendments are not reflected in the compiled text and can be accessed through the Legislation Register. These regulations are essential for compliance within the civil aviation sector, particularly concerning the operation of unmanned aircraft. They ensure a structured and systematic approach to levy imposition based on aircraft weight, facilitating a clear regulatory environment for operators. The regulations' applicability across Australia underscores their national scope, aiming to standardise the levy process for unmanned aircraft operations. The detailed provisions and amendments are captured in the endnotes, providing transparency and facilitating ease of reference for practitioners navigating this legislative framework.

Key Provisions

The Civil Aviation (Unmanned Aircraft Levy) Regulations 2021, made under the Civil Aviation (Unmanned Aircraft Levy) Act 2020, primarily establish the levy amounts for unmanned aircraft (RPA). Section 5 prescribes the amount of the unmanned aircraft levy. Specifically, for an RPA that weighs more than 500 grams, the levy is set at $40, while for an RPA weighing 500 grams or less, no levy is applicable. These provisions are intended to ensure that the appropriate financial contribution is made based on the weight of the unmanned aircraft. The Regulations impose specific obligations on entities operating unmanned aircraft. For example, operators of unmanned aircraft must ensure that they comply with the levy requirements stipulated in the Act. This includes correctly categorising their aircraft based on weight and making the appropriate payment of the levy as prescribed. The Regulations also mandate that these obligations are adhered to in order to maintain compliance with civil aviation laws concerning unmanned aircraft. Failure to comply with the requirements of these Regulations can result in various consequences. While specific offences and penalties are not detailed in the Regulations themselves, it can be inferred that non-compliance could lead to enforcement actions under the overarching Act. The Act may provide for administrative penalties, fines, or other legal repercussions for non-compliance. Given the context of civil aviation and the potential safety implications, penalties could be significant, including potential criminal charges for serious breaches. These Regulations are crucial in governing the financial aspects associated with the operation of unmanned aircraft in Australia. They ensure that operators contribute appropriately based on the weight of their aircraft, thereby supporting the regulatory framework that aims to balance innovation with safety in the civil aviation sector. The precise implications of non-compliance are ultimately dictated by the overarching Act, which would detail the specific penalties and enforcement mechanisms.
