CIVIL AVIATION REGULATIONS (AMENDMENT)
(ISSUED BY THE AUTHORITY OF THE MINISTER FOR SHIPPING AND AVIATION SUPPORT)
Subsection 98(1) of the Civil Aviation Act 1988 (the Act) provides that the Governor-General may make regulations for the purposes of the Act.
Division 2 of Part VI of the Act empowers the Authority to issue, and enforce, statutory liens on aircraft in respect of which there are unpaid charges.
Paragraph (b) of the definition of “aircraft” in subsection 3(1) of the Act provides that in Division 2 of Part VI of the Act “aircraft” means a machine, craft or object of a kind prescribed for the purposes of that Division.
The purpose of the attached Regulations is to prescribe the following kinds of machines, craft and objects for the purposes of paragraph (b) of the definition of “aircraft” in subsection 3(1) of the Act:
(a) all kinds of machines or craft that can derive support in the atmosphere from the reactions of the air;
(b) all kinds of objects designed or adapted for use as aircraft but incapable of being so used because:
(i) a part has, or parts have, been removed; or
(ii) they are in a wrecked or damaged condition.
The Regulations commenced on the date of their notification in the Gazette.
