Overview

The Civil Aviation Amendment Act 1997 was enacted by the Parliament of Australia to make amendments to the Civil Aviation Act 1988. This legislative update aimed to address the operational needs of civil aviation governance by introducing a Deputy Chairperson role within the Civil Aviation Authority (CAA). The appointment and functions of the Deputy Chairperson are outlined in the amendments, providing clarity and additional support for the Chairperson in the administration of the CAA. The Act also includes provisions for the Deputy Chairperson to act in the Chairperson's place when necessary, ensuring continuity in the leadership of the CAA. The policy objective behind these amendments was to enhance the efficiency and effectiveness of the CAA by providing a clear line of succession and support for the Chairperson.

Scope and Application

The Civil Aviation Amendment Act 1997 amends the Civil Aviation Act 1988 to introduce provisions related to the appointment and role of the Deputy Chairperson of the Civil Aviation Authority (CAA). The Act applies to the operations of the CAA, impacting its members, including the Chairperson and Deputy Chairperson, and any processes or decisions made by the board. The legislative changes are intended to ensure continuity of leadership and decision-making within the CAA, particularly during periods of vacancy or absence of the Chairperson. The amendments extend to the Commonwealth jurisdiction, as they involve federal legislation governing civil aviation in Australia. The Act does not explicitly state exclusions, exemptions, or thresholds; however, the specific amendments made are focused on the internal governance and management structure of the CAA, which suggests that the primary exclusions would be external entities or operations not directly managed by the board. The Act may be further refined or expanded through subordinate instruments to clarify or implement the provisions outlined in the amendment.

Key Provisions

The Civil Aviation Amendment Act 1997 introduces several key changes to the Civil Aviation Act 1988, primarily through the inclusion of new definitions and provisions regarding the appointment and roles of the Deputy Chairperson within the Civil Aviation Authority (CAA). Section 2 of the Act amends the definition of "member" in subsection 3(1) to include the Deputy Chairperson, while section 3 specifies that the Deputy Chairperson is included in the quorum required for meetings under paragraph 33(1)(a). Additionally, section 4 increases the number of members required for a quorum to four in paragraph 33(1)(c). Section 5 allows for the appointment of the Deputy Chairperson or another member by the Minister, as outlined in the new subsection 38(2). The Act also stipulates that the Deputy Chairperson can act as the Chairperson under certain conditions, such as during a vacancy or when the Chairperson is unable to perform their duties, as detailed in section 6. The obligations imposed on the parties governed by the Act are primarily administrative and procedural. The Minister is tasked with appointing the Deputy Chairperson, ensuring that there is always a qualified individual to act in the Chairperson's stead when necessary. The Deputy Chairperson must be able to convene meetings if the Chairperson is not present and preside over meetings in the Chairperson's absence, as detailed in section 8. The Deputy Chairperson must also ensure that a quorum is present at all meetings, as specified in section 10. These roles are designed to maintain continuity and efficiency within the CAA, ensuring that operations are not disrupted by the absence of the Chairperson. The Act also outlines potential consequences for non-compliance with its provisions. While specific penalties are not detailed in the Act itself, breaches of the Civil Aviation Act 1988 generally carry significant penalties. For instance, failing to ensure that a quorum is present at meetings could be seen as a failure to comply with operational standards, potentially leading to disciplinary action against CAA officers or members. Additionally, if the appointment of the Deputy Chairperson is not carried out in accordance with the Act, it could result in legal challenges or administrative penalties. The consequences of such breaches are determined by the broader provisions of the Civil Aviation Act 1988, which include fines and other sanctions for non-compliance with aviation regulations.
